WHEREAS, the Memorandum of Understanding jointly pre-

WHEREAS, the additi'na1 annual cost of the compensation
pa kage estimated to be $203, 90 will require a special appropria-
ti n of $170,660 to supplemen the existing sum of $33,230 included
in the Fiscal 1978-79 Budget.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
th City of Chula Vista does ~iereby approve and accept said Memo-
ra dum of Understanding as contained in Exhibit "A" for Fiscal
Ye r 1978-79.

TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF A
CHULA VISTA AND THE CHULA VISTA EMPLOYEES' ASSOCIATION ••~~-••%••~• .............
FOR FISCAL YEAR 1978-79
WHEREA the representatives of the City Manager of the City of Chula Vista, acting
for an on behalf of the City Council of the City of Chula Vista, have heretofore
met an conferred with the Chula Vista Employees' Association affiliated with the
San Di go Public Employees Association,'an organization representing certain members
of eras ified employees in the City of hula Vista, in accordance with the provi-
sions o Section 3500 et seq. of the Go ernment Code of the State of California.
WHEREAS, as a result of meeting and conferring in good faith with said group, agree-
ment ha been reached on the following erms and conditions of employment as applied
to thos classified employees who are m~mbers of and represented by the Chula Vista
Employe s' Association, and said repres ntatives of the City Manager and of the
Chula Vista Employees' Association do n~w jointly prepare a written Memorandum of
Underst nding concerning said agreed teems and conditions of employment for presenta-
tion to the City Council of the City of'~,Chula Vista for determination, to-wit:
1. The City of Chula Vista and theChula Vista Employees' Association hereby
agree to certain salary adjustments as contained in Attachment "A" attached
hereto and incorporated herein ~y reference as it sets forth in full.
2. The City of Chula Vista and the Chula Vista Employees' Association hereby
.agree to the following proposal as contained in Attachment "B" attached
hereto and incorporated herein ~y reference as it .sets forth in full.
3. It is further understood and agreed that any other benefits and working
conditions and the terms and co ditions as specified in this agreement
or other published City documen s thereof presently in effect shall remain
unchanged unless and until said terms and conditions shall be modified as
a result of meeting and conferring in good faith between the City of Chula
Vista and the Chula Vista Emplo ees' Association pursuant to the provisions
of Section 3500 of the Governme t Code of the State of California.
4. If any provision of the agreement, or the application of such provision,
should be rendered or declared invalid by any court action or by reason
of any existing or subsequently enacted legislation, the rema fining parts
r portions o this agreement sh 11 remain in full force and effect.

If the pay option is select d, the paid sick leave hours shall be sub-
tracted from the employee's accumulated yearly sick leave balance. The
remaining sick leave hours hall be carried over and accumulated.
(Example: Employee uses 4 d ys sick leave. He then elects to receive
pay for 25% of remaining da s, or 2 days. The 2 days are subtracted
from his remaining yearly s ck leave and the other 6 days are added
to the employee's accumulat d sick leave balance.)
d. Payment will be made duringlthe month of July of each year. Pay will
be computed based~on the em~loyee's salary step on June 30.
e. Payment will be made to an employee hired during the fiscal year pro-
vided he/she is on the payr~ll June 30. Permanent employees who retire
during the fiscal year will be compensated under this plan based upon
their formal retirement dat'. Prorated payment will be made to an
employee who terminates dur ng the fiscal year. However, in the event
of the death of an individu 1 while employed by the City, 50% of the
employee's unused, accumula ed sick leave will be paid to the approp-
priate beneficiary. i
