FOR FISCAL YEAR 1978-79 WHEREA the representatives of the City Manager of the City of Chula Vista, acting for an on behalf of the City Council of the City of Chula Vista, have heretofore met an conferred with the Chula Vista Employees' Association affiliated with the San Di go Public Employees Association,'an organization representing certain members of eras ified employees in the City of hula Vista, in accordance with the provi- sions o Section 3500 et seq. of the Go ernment Code of the State of California. WHEREAS, as a result of meeting and conferring in good faith with said group, agree- ment ha been reached on the following erms and conditions of employment as applied to thos classified employees who are m~mbers of and represented by the Chula Vista Employe s' Association, and said repres ntatives of the City Manager and of the Chula Vista Employees' Association do n~w jointly prepare a written Memorandum of Underst nding concerning said agreed teems and conditions of employment for presenta- tion to the City Council of the City of'~,Chula Vista for determination, to-wit: 1. The City of Chula Vista and theChula Vista Employees' Association hereby agree to certain salary adjustments as contained in Attachment "A" attached hereto and incorporated herein ~y reference as it sets forth in full. 2. The City of Chula Vista and the Chula Vista Employees' Association hereby .agree to the following proposal as contained in Attachment "B" attached hereto and incorporated herein ~y reference as it .sets forth in full. 3. It is further understood and agreed that any other benefits and working conditions and the terms and co ditions as specified in this agreement or other published City documen s thereof presently in effect shall remain unchanged unless and until said terms and conditions shall be modified as a result of meeting and conferring in good faith between the City of Chula Vista and the Chula Vista Emplo ees' Association pursuant to the provisions of Section 3500 of the Governme t Code of the State of California. 4. If any provision of the agreement, or the application of such provision, should be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the rema fining parts r portions o this agreement sh 11 remain in full force and effect. Said amount will be prorated across the board at $2.50 per regular work day (including any authorized leave with pay). This exces payment shall not be considered in over- time circumstances. 2. Payment will be made duringlthe month of July of each year. Pay will be computed based~on the em~loyee's salary step on June 30. e. Payment will be made to an employee hired during the fiscal year pro- vided he/she is on the payr~ll June 30. Permanent employees who retire during the fiscal year will be compensated under this plan based upon their formal retirement dat'. Prorated payment will be made to an employee who terminates dur ng the fiscal year.
