In J~ily 1986 the City Counci l directed staff to prepare an agreement for the
undergrounding of existing utilities on the City owned Telegraph Canyon Road
property which is currently being conveyed to Kids Unlimited. The agreement
has been prepared and is presented with a related modification to the approved
Disposition and Development Agreement with Kids Unlimited and Utility Easement
for Council consideration.
RECOMMENDATION: Adopt the attached resolution 1) entering into an agreement
with Kids Unlimited providing for the future undergrounding of an existing
on-site overhead electrical facility; ?_) modifying the approved Disposition
and Development Agreement with Kids Unlimited relative to the electrical
conversion; and 3) accepting an easement for future undergrounding purposes.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The attached agreement provides for Kids Unlimited's portion of future
undergrounding of an existing overhead electrical facility located in the
vicinity of Paseo del Rey and Telegraph Canyon Road. Kids Unlimited agrees to
waive the right to protest the formation of an undergrounding district as well
as deposit a maximum of $11,000 into the district fund (as approved by City
Council on 7/8/86) and grant an easement for the underground facilities. This
document will be deposited into the City's escrow account and will be recorded
with the deed conveying the property to Kids Unlimited.
In addition, a new section has been added to the approved Disposition and
Development Agreement (Exhibit B of attached Resolution) which requires the
mutual approval of the agreement and easement as a condition of the property
sale.
The City Attorney has reviewed these documents and approves the format and
provisions.
FISCAL IMPACT: Kids Unlimited, as the purchaser of the City site, will
contribute their fair share of the cost to underground overhead electrical
facilities. Also, obtaining an easement for the undergrounding will avoid the
potential expenditure of funds in the future to acquire an easement.
