On January 9, 1986, the Chula Vista Police Department culminated a four month
undercover narcotic sales investigation when the Crime Suppression Team served
a search warrant at 1990 Dunning Circle, San Diego, and affected three arrests.
During the search warrant service, officers seized i~eroin, cash, and other property.
Subsequent to the search warrant service, a Crime Suppression Team member was
placed at the U.S. Mexican border to seize the 1982 Chevrolet Blazer that had
been used to facilitate the sales of narcotics involved in this investigation.
The vehicle entered the U.S. the same day and was seized and stored. It is our
intention to pay off the lien on this 1982 Chevro let Blazer and use it as a
replacement canine vehicle.
RECOMMENDATION: That Council authorize the appropriation of funds and purchase
of the 1982 Chevrolet Blazer

DISCUSSION:
On October 12, 1984, President Reagan signed into law the Comprehensive Crime
Control Act of 1984. This law provides for the distribution of federally seized
and forfeited assets to law enforcement agencies who participate in the investigation
which resulted in the asset seizure. The assets consist of cash, real property and
vehicles that have been forfeited by those who acquire it for use, use it for the
purposes of, or are the resultant profit from illegal activity.
It is important to note that the purpose behind the asset forfeiture sharing is
that the tangible property or cash be credited to the budget of the state or local
law enforcement agency that directly participated in the seizure. The funds or
property are meant to be utilized for increasing state and local law enforcement
resources for that specific agency and not for general use.
The 1982 Blazer seized by this department is legally owned by M.A.C., P.O. Box 8300,
Newport Beach, California. The lien on the Blazer is $4,138.68, including
advertisement costs and storage fees.
The 1982 Blazer is stored at Rhodes Storage in Chula Vista. It has been inspected
by John Alden, ofthe Chula Vista City Maintenance Garage, and found to be in good
shape. Its blue book value is approximately $8,000.

The canine vehicle is scheduled for replacement in the current 1986-87 Equipment
Replacement Fund and the Blazer will be utilized as the replacement. The Blazer
is equipped with four-wheel drive and would allow for canine access to those areas
presently difficult to reach with the normal patrol vehicle.
The $4,138.68 cost is significantly less than the City would pay for a new canine
patrol unit and would allow us a good opportunity to see how valuable this type of
equipment can be in our working environment.
Up to this time, we have received a total of $3,580.50 cash from two other drug
seizure cases. This money has been turned over to the Finance office and is
being maintained in a separate account (General Fund No. 3692). We also have
six other arrest/seizure requests pending with the Federal government totaling
approximately $12,900 and these funds will be received some time within the next
six to twelve months. As these funds are received, staff will be bringing requests
to Council for the expenditure of these funds for law enforcement purposes.
FISCAL IMPACT:
The 1986-87 Equipment Replacement Fund budgeted $12,236 for replacement of the
canine vehicle. Staff is proposing to purchase the 1982 Chevrolet Blazer as the
replacement utilizing $3,580.50 of Asset Seizure funds and $558.18 of the funds
budgeted in 1G86-87 for a total purchase price of $4,138.68. The use of the
remaining money in the fund saved because of this proposed purchase will be evaluated
in light of other vehicle needs in the Police Department.
