The Final Map for CVT 82-11, Rio Otay Industrial Park, has been reviewed by
the Engineering Department and found to be in conformance with the Tentative
Map approved by the City Council on April 20, 1882, by Resolution No. 10835.
RECOMMENDATION: That Council adopt resolutions as listed in the item title
of this report.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The Final h1ap for CVT 82-11 (which is the legal document creating a total of
18 industrial lots and granting easements within the subdivision boundary) has
been checked by staff and is recommended for approval.
All conditions of approval placed upon the Tentative flap have been met. The
developers have paid all fees and submitted all required documents and have
executed a Subdivision Improvement Agreement. The developers, Rio Otay
Industrial Venture, are in escrow to purchase the property from the Darling
Delaware Company, the current owners. The purchase will occur prior to
recordation of the Final Map.
It should be noted that Rio Otay Industrial Venture is signing the Subdivision
Improvement Agreement, ayreements to not protest formation of improvement
districts and the agreernent regarding the ongoing monitoring of the disposal
site as owners. The City Attorney's office concurs in Rio Otay Industrial
Venture signing these agreements.

The developers are unable to obtain surety bonds to guarantee the subdivision
improvement agreement until the City Council has approved the Final Map. As
provided for in the City Code, it is proposed that Council approve the Final
Subdivision Map subject to the condition that the Final Map not be released
for recordation until acceptable bonds are provided.
After the Final Map is recorded, the Darling Delaware Company will repurchase
lot 4, which contains a closed hazardous waste disposal site from the Omar
Rendering plant. Both the parties (Darling Delaware and Rio Otay) have
executed separate agreements to adhere to the requirements of Order 80-06 of
the California Regional Water Quality Control Board regarding the ongoing
monitoring of the disposal site.
Approval of the Map constitutes acceptance of tree planting and maintenance
easements within the subdivision and acceptance on behalf of the public of
Delniso Court, Roma Court and a portion of Otay Valley Road as shown on the
Final Map.
In addition to being responsible for the construction of improvements in Otay
Valley Road under the Subdivision Improvement Agreement and guaranteeing by
posting of bonds, the developers have submitted a petition for the formation
of an improvement district for the widening and improvement of Otay Valley
Road. They have also executed an agreement wherein they agree to not oppose
formation of such a district or to the formation of a district for the purpose
of increasing the sewer capacity for the Otay Valley.
