HomeMy WebLinkAboutReso 1988-13825 RESOLUTION NO. 13825 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING NEGATIVE DECLARATION IS-88-17, FINDING THAT THE PROPOSED PROJECT IS CONSISTENT WITH THE CERTIFIED CHULA VISTA LOCAL COASTAL PROGRAM, AND APPROVING COASTAL DEVELOPMENT PERMIT NO. 043 FOR CONSTRUCTION OF MODIFICATIONS TO ROHR INDUSTRIES BUILDING #99 AT 390 BAY BOULEVARD The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista Local Coastal Program (LCP) has been certified by the California Coastal Commission; and WHEREAS, said LCP includes Coastal Development procedures determined by the Commission to be legally adequate for the issuance of Coastal Development Permits and the City of Chula Vista has assumed permit authority of the Chula Vista Coastal Zone; and WHEREAS, a public hearing was duly noticed and held on October 25, 1988, in accordance with said procedures; and WHEREAS, the City Council of the City of Chula Vista, as "approving authority" has reviewed and considered the information contained in IS-88-17. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: A. The City Council hereby adopts Negative Declaration IS-88-17 attached hereto as Exhibit A; and B. Based on the following findings, the City Council hereby finds that the proposed construction of modifications to Rohr Industries Building #99 at 390 Bay Boulevard, subject to conditions listed in Exhibit B attached hereto and incorporated herein as though fully set forth, is consistent with the policies of the Chula Vista Bayfront Local Coastal Program. Findings Based on the following findings the proposed project at 390 Bay Boulevard, subject to conditions listed in Exhibit B, is found to be consistent with the policies of the Chula Vista Bayfront Local Coastal Program. -1- 1. The research and development land use proposed by the applicant is permitted within the site's industrial business park land use designation. The total floor area is within the maximum .5 floor area ratio allowed in the Local Coastal Program. The proposed research and development commercial land use is consistent with the land use standards and requirements set forth in the certified Chula Vista Bayfront Local Coastal Program. 2. No major grading is proposed. Minor excavation for footings and foundation will be protected when work is not being undertaken. This work is not anticipated to cause downstream siltation and is consistent with the LCP's areawide grading policies. 3. The project site is not located adjacent to the San Diego Bay or any other water-oriented resource, therefore, does not afford the opportunity for public access to any water-related recreational use and is not inconsistent with the public access policies of the Coastal Act. Statewide and regional interpretive guidelines have been reviewed and the proposed project has been found to be in conformance with the public access and public recreational policies of Chapter 3 of the Public Resources Code. 4. The project provides the expansion of existing industrial facilities within the area shown as industrial use on the LCP's Land Use Plan and is consistent with the industrial development and energy facilities policies of the Certified LCP. C. The City Council of the City of Chula Vista hereby authorizes the issuance of Coastal Development Permit #043 subject to the conditions listed in Exhibit B. During foundation and footing work, all loose soil and backfill material shall be protected by Visqueen or similar material while work is not being conducted on-site to avoid siltation downstream. 2. Sellgren negative declarationEXI!!BIT A, PROjECT NAME: Construction of Walls to Enclose Service Bay Areas PROJECT LOCATION: 390 Bay Boulevard PROjECT APPLICANT: Rohr Industries CASE Ne: IS-89-17 DATE: September 27, 1988 A. Project Setting The project site is located at the northwest corner of Bay Boulevard and "G" Street. It is currently developed with the Detroit Diesel Building. The project site has been developed for a number of years aria is void of any natural or manmade cultural resources. This area is within the Coastal Zone and requires the issuance of a Coastal Permit for development. There are industrial uses to the north, to the west is the San Diego and Arizona Eastern Railroad, the SDG&E transmission lines from tile South Bay Power Plant, and a cogeneration facility. To the south across "G" Street are existing Rohr facilities, and to the east across Bay Boulevare is Interstate 5. Various tests of soils and ground water at the site were conducted in 1986 to determine what, if any, contamination by hazardous materials existed on the property. The results concluoed that there were only lcw levels of contamination present. In early 1987 three subsurface storage tanks with a total capacity of 20,550 gallons were removed under inspection of the City of Chula Vista Fire Prevention Bureau and the County of San Diego Hazardous Materials Management Unit. No soil or ground water contamination was apparent and backfill of the area was permitted. B. Project Description Phase I The project consists of interior improvements to Builoings 99 and lO0. The addition of a second floor in the middle warehouse and south warehouse bay providing about 16,000 sq. ft. of additional floor area is proposed. The use of the building is proposed to be research and development with associated offices and indoor storage. Approximately 200 employees will occupy the building. No change is proposed from the existing percentage of building coverage, paved area coverage, or landscaping. No additional grading of the site is necessary to implement this project. This is considered as part of this overall project. C. Compatibility with Zoning and Plans The Chula Vista Bayfront Specific Plan designates the area as Industrial Business Park. The proposed research and development facility with associated offices conform to the Specific Plan. D. Compliance with the Threshold/Standards Policy 1. Fire/EMS The estimated Fire/EMS response time is three minutes which is within the seven-minute threshold standard. 2. Police The Police Department is currently maintaining an acceptable level of service based on the threshold standard. 3. Traffic The Engineering Department has reviewed the proposal ano hash concluded that the project will not change the level of service c roads or intersections serving this property. 4. Parks/Recreation The threshold standard for Parks and Recreation does not apply to this project because it is an industrial use. 5. Drainage Review of the specific development proposals by the City will assure that storm water flows and volumes will not exceed engineering standards. 6. Sewer Review of the specific development propcsals by the City will ensure that sewage flows and volumes will not exceed City engineering standards. 7. Water The Sweetwater Authority was contacted and indicated they could serve this project. E. Identification of Environmental Effects In accordance with the Initial Study for this project, the proposal will not result in any significant environmental effects. F. Findings of Insignificant Impact 1. The entire site has been developed for a number of years and is void of any significant natural of manmade resources that could be affected by this proposal. 2. The project conforms to the long-range development and protection plan for the Chula Vista Bayfront and, therefore, will not achieve any short-term objectives to the disadvantage of these longer-term goals. 3. This developed project site is within the confines of a larger industrial area. This minor expansion will, therefore, not have any cumulative effect which could adversely affect the environment. 4. The project will not result in the emissions of any substances, noise, vibration, glare, etc. which could adversely impact human beings. Soils and ground water at the project site have been tested for hazardous materials and it was found that there were no hazards on site. G. Consultation 1.
