HomeMy WebLinkAboutReso 1988-13824 Revised 10/21/88 RESOLUTION NO. 13824 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING STAFF TO PARTICIPATE IN THE PAYMENT FOR A SOILS INVESTIGATION WITHIN THE RIGHT OF WAY AND IN THE PREPARATION OF PLANS FOR THE CONSTRUCTION OF IMPROVEMENTS WITHIN "C" STREET The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on December 15, 1987 the City of Chula Vista and the South Bay Pioneers entered into an agreement providing for the joint installation of improvements in "C" Street along the frontage of the property owned by the Pioneers, and WHEREAS, these improvements were required to be installed in conjunction with the construction of 18 residential units within their property under Conditional Use Permit PCC-87-8, and WHEREAS, the Council received a request from the Pioneers at its meeting of August 16, 1988 that this agreement be amended and referred the request to staff for analysis and possible preparation of an appropriate amendment to the greement, and WHEREAS, it is noted that the tentative map for Chula Vista Tract 88-9 has been filed for the property immediately across "C" Street from the Pioneers property and improvements within "C" Street will also be required of that developer, and WHEREAS, representatives of the South Bay Pioneers and the Engineering Division have discussed combining these projects to achieve the completion of the "C" Street improvements from the westerly line of Del Mar Avenue to Third Avenue Extension, and WHEREAS, it is proposed that a soils investigation for the full width of "C" Street be conducted with the work being accomplished by Benton Engineering under an agreement with the developer, Ron Helderlein, and be paid for by him and the City in equal amounts, and WHEREAS, it is proposed that design plans for the improvement of the full width of "C" Street be prepared by Algert Engineering in an agreement with the developer, Ron Helderlein, and be paid for by him and the City in proportion to the extent of work being paid for by each, and WHEREAS, it is recommended that staff return with an ~greement providing for the City's participation in the modified ~oject after completion of plans for that project. -1- NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby authorize staff to articipate in the payment for a soils investigation within the fight of way and in the preparation of plans for the construction of improvements within "C" Street. The Trustees of the South Bay Pioneers agrees to your proposal as outlined in the above letter. In the twenty seven years that the South Bay Pioneers has been in existance in the City of Chula Vista,we have had nothing but good co-operation from thestaff. ,s the South Bay Pioneers is not a profit making entity we would hope that the new three way agreement wilt protect the South Bay Pioneers interest as a Charitable Organization.
