This item involves an application for a precise plan to divide a 21,760 sq. ft parcel into three lots at 89 Quintard Street in the R-1-5-P zone. The applicant is also requesting a reduction in the required sideyard setback from 5 feet to 4 feet on the west side of the center lot. 2. On November 22, 1978 the Planning Commission adopted the PJegative Declaration on IS-79-27 which is herewith forwarded to council. B. DISCUSSION 1. Adjacent zoning and land use. The property is developed with a single family dwelling located in the approximate center of the lot setting back 34 feet from the street. The site is elevated slightly above the street and slopes gently to the rear. The property to the rear is lower than the subject property and has been divided into 3 panhandle lots served by a 20 foot wide driveway adjacent to the easterly property line qf the subject proppert EXHIBITSIContinued nn si~nlPmPntal ~~a) FINANCIAL IMPACT STAFF RECOMMENDATION Concur with Planning Commission recommendation BOARD/COMMISSION RECOMMENDATION On November 22, 1978 the Planning Commission voted 7-0 to recommend that the City Council approve the precise plan for development of three single family lots at 89 Quintard in accordance with Resolution PCh1-79-13. COUNCIL ACTION Form A-113 (Rev. 5/77) AGENDA ITEM N0. 7, 7a Meeting of 12/19/78 Supplemental Page No. 2 3. Proposed development The applicant proposes to divide the property into three lots. The center lot will have 60 feet of street frontage, whereas, the lot on either side will have 50 feet of frontage. The existing house will be remodeled by removing a 10' wide center breezeway located between the garage and the main structure. The remaining portion of the house will be moved east to join the garage leaving a 4' setback on the west side and a 6' setback on the east side. A 5 foot setback on the west side would require moving the existing garage by 1' causing unnecessary additional expense which is not warranted because the proposed dwellings on the adjacent lots will be located 11' from either side of the dwelling. The homes proposed on the newly created lots will be similar to the models proposed for the adjacent single family subdivision to the east which have been designed to fit on a 5000 sq. ft. lot. The homes will also set back 34 feet from the street in line with the existing dwelling. 4. Precise Plan Guidelines The precise plan guidelines established with the original rezoning of the site, set forth a minimum front yard setback of 15', thus each house will exceed that requirement. Those guidelines also stipulated that compensating open space would not be required. (Note: The two smaller lots will contain 6800 sq. ft. and the center lot 8160 sq. ft., all well over the 5000 sq. ft. minimum.) C. ANALYSIS The proposed project is a conventional development which meets the precise plan guidelines and the requirements of the underlying zone except for the 4 foot sideyard setback.
