RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING FIRST AMENDMENT TO AGREEMENT BETWEEN THE
CITY OF CHULA VISTA AND THE CITY OF IMPERIAL BEACH
PROVIDING FOR THE USE OF CHULA VISTA'S POUND FACILITIES
AND SERVICES, AUTHORIZING THE MAYOR TO EXECUTE SAID
AMENDMENT AND RESCINDING RESOLUTION NO. 13699
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain First Amendment to
Agreement between THE CITY OF CHULA VISTA, a municipal
corporation, and THE CITY OF IMPERIAL BEACH, providing for the
use of Chula Vista's Pound Facilities and services, dated
the 25th day of October , 198 8 , a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said Amendment for and on behalf of the City of Chula
_Vista.
BE IT FURTHER RESOLVED that Resolution No. 13699 be, and
the same is hereby rescinded.

FIRST AMENDMENT TO AGREEMENT BETWEEN
THE CITY OF CHULA VISTA AND THE CITY
OF IMPERIAL BEACH PROVIDING FOR THE USE
OF CHULA VISTA'S POUND FACILITIES AND SERVICES
THIS AGREEMENT, made and entered into this 16th
day of August , 1988, by and between THE CITY OF
CHULA VISTA, a municipal corporation, hereinafter called
"Chula Vista", and THE CITY OF IMPERIAL BEACH, hereinafter
called "Imperial Beach";
WITNESSETH :
WHEREAS, the City of-Imperial Beach desires to use
the pound facilities of the City of Chula Vista as a
shelter for the impounding and disposing of dogs and small
animals, and
WHEREAS, the City of Chula Vista has pound facilities
adequate to serve the needs of the City of Imperial Beach
in addition to the present use by the City of Chula Vista,
and
WHEREAS, the City of Imperial Beach desires to amend
the 1987 agreement with the City of Chula Vista for the
use of the pound facilities of the City of Chula Vista as a
shelter for the impounding and disposing of dogs and small
animals, and
WHEREAS, Chula Vista is willing to extend said
agreement in the manner set forth herein.
NOW, THEREFORE, IT IS AGREED by and between Chula
Vista and Imperial Beach as follows:
1. Paragraphs 5 and 6 of the Agreement dated July
21, 1987 between Imperial Beach and Chula Vista relating
to pound facilitiesare amended to read:
5. Animals brought into the Shelter will be
euthanized if they are not redeemed by their owners or
adopted by new owners. In any case, euthanasia will
not take place any sooner than three working days if
the animal was not wearing a license tag when
impounded and not less than five working days if
wearing a license tag. The Imperial Beach City
Council opposes the practice of "pound seizure",
therefore, animals impounded in all portions of the
incorporated territory of the City of Imperial Beach
(92032) shall not be released for the purpose of
medical research.
6. Retroactive to July 1, 1988 and extending through
June 30, 1989, Imperial Beach agrees to pay the City
of Chula Vista the sum of ONE THOUSAND THREE HUNDRED
NINETEEN DOLLARS AND SEVENTY-FIVE CENTS ($1,319.75)
per month for the aforementioned services and
facilities. The Finance Officer of the City of Chula
Vista shall, as of the first day of each month, credit
Imperial Beach with the amount of monies received
during the previous month from Imperial Beach
residents as fees for redemption or adoption of
Imperial Beach animals. To the balance of funds
remaining to be paid, a one percent (1%) service and
billing charge shall be applied. The Finance Officer
shall submit the billing to Imperial Beach on or
before the 1Oth day of the month following the billing
period, and that amount shall be due and payable upon
receipt by Imperial Beach, but in no event later than
the last day of the billing month.
2. All Other terms and conditions of the original
agreement remain in full force and effect.
IN WITNESS WHEREOF, this agreement is executed by the
City of Chula Vista acting by and through its Mayor and by
the City of Imperial Beach acting by and through its Mayor,
the date and year first hereinabove written.
