RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VI5TA APPROVING PRECISE PLAN FOR DEVELOPP~IF'NT OF THREE
SITIGLE FAMILY LOTS AT 89 QUINTARD STREET IN THE
R-1-5-P ZONE, AND CERTIFYING THE NEGATIVE DECLARATION
The City Council of the City of Chula Vista finds as
folllows
That in accordance with the attached Negative Declaration,
IS 79-27 and the findings therein, the precise plan for development
of three single family lots at 89 Quintard Street in the R-1-5-P
z e will not have a significant impact upon the environment, and
t e City Council hereby certifies that the Negative Declaration
w s prepared in accordance with the California Environmental
Q ality Act of 1970 as amended.
The City Council of the City of Chula Vista does hereby
r solve as follows:
WHEREAS, the City Council of the City of Chula Vista has
h retofore received the recommendation of the Planning Commission,
a contained in Resolution Tdo. PCM-79-13, adopted on the 22nd day
o November, 1978, setting forth the precise plan for development
o three single family lots at 89 Quintard Street in the R-1-5-P
z ne, and
WHEREAS, the City Council has heretofore held a public
h aring to consider said precise plan on December 19, 1978 and
h.s taken testimony and heard evidence thereon.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
t e City of Chula Vista does hereby approve the precise plan for
d velopment of three single family lots at 89 Quintard Street in
t e R-1-5-P zone in accordance with Planning Commission Resolution
N PCM-79-13.

A~. Project Setting
DATE: November 9, 1978
T e project involves .50 acres of property located at 89 Quintard
S The site is currently developed with one single family dwelling
a d decorative landscaping. Adjacent uses include single family
r sidences to the north and south, a single family (detached) sub-
d'vision currently being constructed to the east and vacant R-3-P-12
z ned property to the south.
T e site is generally void of any significant vegetation or natural
r sources. According to a geological study prepared in 1976 for
p operty located at the northeast corner of Quintard & Tobias Sts.,
a earthquake fault inferred by photographic evidence, may be
p esent within the vicinity of the subject project. Potentially
e pansive soils may also be present.
B~ Project Description
T e applicant proposes to subdivide the existing half-acre parcel
i to three separate lots for the purpose of constructing two additional
s ngle family dwellings. The existing home will remain, though
s mewhat modified, and will retain approximately 8160 sq. ft, of land
a ea. Both new parcels will consist of 6800 sq. ft. of land and will
a commodate homes with 1300+ sq. ft. of floor area.

T e subject site is zoned R-1-5-P which allows single family
c nstruction on 5000 (minimum) lots with precise plan approval.
T e proposal is in conformance with the existing zoning and medium
d nsity established by the General Plan. '
D} Identification of environmental effects

E pansive soils have been found to exist on neighboring property
( ee EIR-76-1). A soils ahalysis will be prepared prior to con-
s ruction and appropriate recommendations of the Soils Engineer
s ould be followed to ensure stable construction.

A geological report was prepared in 1976 for a neighboring sub-
d vision at the northeast corner of Quintard & Tobias Sts. This
r port concluded that the site was not underlain by the inferred
s gment of the Sweetwater fault but the fault may lie to the west.
I the fault does exist westward, it may underlie the proposed
p oject area. To avoid the possibility of construction over a
p tential geologic hazard, a preliminary geologic survey containing
a registered engineers conclusions and recommendations should be
p epared and submitted to the Environmental Review Committee prior to
a proval of the final parcel map.

e local elementary school is currently operating over capacity. New
udents from the proposed project will further increase current
rollments. Developers contributions will be required to be submitted
the Chula Vista Elementary School District and will provide
mporary classroom space for new students. School district policies
lating to boundary changes and school assignments will also serve

Mitigation to avoid significant impact
1. A soils analysis will be prepared prior to construction.
2. A preliminary geological report should be prepared prior
to approval of the final parcel map,
Findings of insignificant impact

1. The project site is generally void of any natural resources.
Expansive soils and an inferred earthquake fault may be present
on site; however, these potential hazards will be mitigated.
(See Sec. E above)
2. The project is in basic conformance with the General Plan
and is not anticipated to achieve short term to the disadvantage
of long term environmental goals.
3. Potential impacts can be mitigated to an acceptable level
and none are expected to interact to create any substantial
adverse effect on the environment.
4. The proposed residential units will not generate any
appreciable increase in traffic or related emissions and ambient
noise levels will not be adversely affected.

RESOLUTIOPJ OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF A PRECISE PLAN FOR THE DEVELOPMENT
OF THREE SINGLE FAMILY LOTS AT 89 QUINTARD STREET
WHEREAS, Ordinance No. 1702, adopted by the City Council on August 31,
1976, established the R-1-5-P zone for certain property north of Quintard Street
between First Avenue and Tobias Drive, and
WHEREAS, on October 27, 1978 a precise plan was submitted by Robert S.
Eldred for the development of three single family lots on a 21,760 sq. ft. parcel
located at 89 Ouintard Street, and
WHEREAS, the City Planning Commission, at a duly advertised public hearing
held at 7:00 p.m. on November 22, 1978 in the Council Chamber, City Hall, 276 Fourth
Avenue, considered the precise plan as submitted, and
41HEREAS, the Planning Commission found that the proposed project would not
have any significant adverse environmental impact and adopted the Negative Declara~
tion on IS-79-27.
NOW, THEREFORE, BE IT RESOLVED that the City Planning Commission finds as
follows:
a. That such plan will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or working
in the vicinity, or injurious to property or improvements in the vicinity.
Reducing the side yard setback of one of the lots to 4 feet will not be detri-
mental since the houses will maintain a minimum 10 foot separation between
units.
b. That such plan satisfies the principles of the application of the P P~odifying
District as set forth in Section 19.46.041.
The proposed development exceeds the precise plan guidelines and meets the
requirements of the R-1-5 zone except for a 4 foot sideyard on one lot.
c. That any exceptions granted which deviate from the underlying zoning require-
ments shall be warranted only when necessary to meet the purpose and application
of the P Precise Plan Modifying District.
The reduction in the required side yard setback from 5 feet to 4 feet is
warranted to allow the applicant to remodel the existing dwelling by removing
an enclosed breezeway and moving the main dwelling to connect with the garage
without removing and altering bearing walls.
That approval of this plan will conform to the General Plan and the adopted
licies of the City.
The density of the project is consistent with the General Plan designation for
this area of 4 to 12 dwelling units per acre.
BE IT FURTHER RESOLVED that the City Planning Commission recommends that
~e City Council approve the precise plan for the development of three single
Emily lots at 89 Quintard Street, subject to:
1. The undergrounding of all utilities,
2. Site plan and architectural approval, including floor plans, shall
be reviewed and approved by the Planning pepartment prior to issuance
of a building permit.
