HomeMy WebLinkAboutReso 1978-9414 RESOLUTION NO. 9414 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PRECISE PLAIQ FOR DIVISIOT•1 OF PROPERTY AT 21 QUINTARD STREET INTO FOUR LOTS, AND CERTIFYING THE NEGATIVE DECLARATIOPI The City Council of the City of Chula Vista finds as fo111ows That in accordance with the attached Negative Declaration, IS- 9-28 and the findings therein, the precise plan for division of pro erty at 21 Quintard Street into four lots will not have a sig- nif'cant impact upon the environment, and the City Council hereby cer ifies that the Negative Declaration was prepared in accordance wit the California Environmental Quality Act of 1970 as amended. The City Council of the City of Chula Vista does hereby res lve as follows: WHEREAS, the City Council of the City of Chula Vista has her tofore received the recommendation of the Planning Commission, as ontained in Resolution No. PCM-79-14, adopted on the 22nd day of ovember, 1978, setting forth the precise plan for division of pro erty at 21 Quintard Street into four lots, and WHEREAS, the City Council has heretofore held a public hea ing to consider said precise plan on December 19, 1978 and has taken testimony and heard evidence thereon. NO6~, TEiEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the precise plan for div sion of property at 21 Quintard Street into four lots in acc rdance with Planning Commission Resolution No. PCB![-79-14. Project Setting Th project involves .912 acres of property located at 21 Quintard St. Th -site is currently developed with two single family dwellings and an decorative landscaping. Adjacent uses include single family re idences to the northeast and south, and a subdivision of single fa ily (detached) homes is currently being constructed to the west. Th site is generally void of any significant vegetation or natural re ources. According to a geological study prepared in 1976 for pr perty located at the northeast corner of Quintard and Tobias Sts. an earthquake fault inferred by photographic evidence may be present wi hin the general vicinity of the subject project. The fault is ex ected to be located to the wE~st of this site however. Potentially ex ansive sails may also be present. B.I Project Description Th applicant proposes to subdivide the existing parcel into four se arate lots for the purpose of constructing three additional single fa ily dwellings. The existing homes will remain and will retain ap roximately 19,815 sq. ft. of land area. New parcels will consist of approximately 6600 sq, ft. of land and will accommodate homes with 13 0 to 1400 sq. ft. of floor area. C.I Compatibility with zoning and•plans Th subject site is zoned R-1-5-P which allows single family construction on 5000` (minimum) lots with precise plan approval. PCM-79-14 ~ RESOLUTION OF THE CITY PLAfJNING COMMISSION RECOP~MENDING TO THE CITY COUNCIL THE APPROVAL OF A PRECISE PLAN TO DIVIDE PROPERTY AT 21 QUINTARD STREET INTO FOUR LOTS WHEREAS, Ordinance No. 1702, adopted by the City Council on August 31, 1976, ~tablished the R-1-5-P zone for certain property north of Quintard Street between rst Avenue and Tobias Drive, and WHEREAS, on October 27, 1978 a precise plan was submitted by Robert S. Eldred divide a 39,600 sq. ft. parcel at 21 Quintard Street into four lots, with three lets to be served by a 20 foot wide access driveway, and !dHEREAS, the City Planning Commission, at a duly advertised public hearing ld at 7:Q0 p.m. on November 22, 1978 in the Council Chamber, City Hall, 276 Fourth enue, considered the precise plan as submitted, and WHEREAS, the Planning Commission found that the proposed project would not de any significant adverse environmental impact and adopted the Negative Declara- on on IS-79-28. NOW, THEREFORE, BE IT RESOLVED that the City Planning Cor~nission finds as llows: y a. That such plan will not, under the circumstances of the particular case, be trimental to the health, safety or general welfare of persons residing or working the vicinity, or injurious to property or improvements in the vicinity. The proposed project is similar to the approved development for the Shepherdvil1e subdivision in the immediate vicinity. It is also similar to an approved project on the adjacent property to the east which also proposed a panhandle lot. Since the development is in keeping with the approved development in the area it should not be detrimental to persons in the area or injurious to property. That such plan satisfies the principles of the application of the P Modifying strict as set forth in Section 19.46.041. The proposed plan meets the guidelines of the P District and the require- ments of the underlying zone for 5,000 sq. ft. lots. That any exceptions granted which deviate from the underlying zoning require- is shall be warranted only when necessary to meet the purpose and .application f the P Precise Plan Modifying District.. The proposed development, creating lots without street frontage, is a development concept which has been employed and encouraged for this area. The subject property has developments abutting the east and west property lines which have been approved without public street frontage. y/y opted policies of the City.. The responsibility for the maintenance and cost of maintenance of all common areas, roads or easements and guest parking areas shall be equally shared by the property owners of Lots 1, 2, and 3. This shall be accomplished through the formation of a homeowner's association. 4. The following setbacks shall be observed: Side yard - 5 feet Rear yard - 20 feet for initial construction. 5. No garage conversions shall be permitted. 6. Accessory structures shall not be located closer than 10 feet to any dwelling located on adjacent property. 7. Site plan and architectural approval including floor plans shall be reviewed and approved by the Planning Department prior to the issuance of a building permit.
