HomeMy WebLinkAboutReso 1988-13803 RESOLUTION NO. 13803 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RELEASING THE DEVELOPERS OF CORONA VISTA SUBDIVISION FROM THE REQUIREMENT TO CONSTRUCT CERTAIN IMPROVEMENTS IN OTAY LAKES ROAD AND AUTHORIZING THE RELEASE OF SURETY BONDS GUARANTEEING SAID IMPROVEMENTS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on November 11, 1987, the City Council approved Resolution 13323, approving the Final Map and Subdivision Improvement agreement for Corona Vista Subdivision, located northeasterly of Otay Lakes Road, and WHEREAS, a provision of the Subdivision Improvement agreement required the developer to widen Otay Lakes Road along the project's frontage and to submit surety bonds to guarantee the required improvements, and WHEREAS, Rancho del Rey Partnership, in conjunction with the development of the Rancho del Rey Subdivision, has prepared plans for the reconstruction of Otay Lakes Road, from Camino del Cerro Grande to Ridgeback Road which includes realignment of the road to conform to current City standards, and WHEREAS, along the Corona Vista Subdivision frontage, the realignment will move the road away from the subdivision thus eliminating the need for the widening previously required of Corona Vista, and WHEREAS, the developers of Rancho del Rey have submitted bonds to guarantee construction of the realignment and it is now reasonable to release the developers of Corona Vista from the obligation to construct the previously required improvements and to allow the bonds guaranteeing said improvements to be released. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby release the developers of Corona Vista Sudivision from the requirement to construct certain improvements in Otay Lakes Road and authorizes the release of surety bonds guaranteeing said improvements. A provision of the Subdivision Improvement agreement required the developer to widen Otay Lakes Road along the project's frontage. The developers submitted surety bonds to guarantee the required improvements. RECOMMENDATION: That Council approve the resolution listed above. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Rancho del Rey Partnership, in conjunction with the development of the Rancho del Rey Subdivision, has prepared plans for the reconstruction of Otay Lakes Road, from Camino del Cerro Grande to Ridgeback Road. Said reconstruction includes realignment of the road to conform to current City standards. The developers of Rancho del Rey have submitted bonds to guarantee construction of the realignment. It is now reasonable to release the developers of Corona Vista from the obligation to construct the previously required improvements and to allow the bonds guaranteeing said improvements to be released. The developers of Corona Vista will still participate in the construction of Otay Lakes Road through the payment of Development Impact Fees. Plats are available for Council viewing.
