On Ap it 22, 1981 Mr. Colin Seid of Paseroga Partnership submitted to the City a petition
fora reorganization involving annexation of 3.77 acres of land to the City of Chula
Vista and detachments from the Montgomery Fire Protection District, the Montgomery
Sanit tion District and the San Diego County Flood Control District-Zone 4.
The p oposal area is uninhabited (less than 12 registered voters residing within the
propo al area) and consists of four tax parcels. The proposal was not processed by LAFCO
as a 00% consent item since one of the four property owners (Montgomery Sanitation
District) had not officially consented to the proposal prior to the scheduling of LAFCO's
publi hearing; therefore, it is required by the government code that Council conduct
a pub is hearing. It should be noted, however, that just prior to LAFCO's public hearing
the p oposal did receive 100% consent of the involved property owners. The proposal area
is sh wn on Exhibit A of this report.
RECOMMENDATION: That Council:
A opt a resolution initiating proceedings and setting a public hearing for January 5,
1982 to consider the proposed "Lotus Drive Reorganization" involving annexation to
the C'ty of Chula Vista and detachments from the Montgomery Fire Protection District,
the M ntgomery Sanitation District, and the San Diego County Flood Control District-Zone 4.
DISCUSSION
1. The proposal area is located on the north side of Main Street in the unincorporated
terri ory of San Diego County (Woodlawn Park). The proponent is requesting annexation
to th City of Chula Vista in order to obtain an increased level of municipal services
over hat which is currently provided in the County of San Diego.
2. The subject property is presently vacant and consists of four tax parcels.
The a nexation proponent intends to resubdivide the area into 29 lots for the purpose
of de eloping two open space lots and 27 residential lots for the future construction
of si gle family dwellings. Such a plan was approved by Council on November 3, 1981.
Environmental Review.
T e Environmental Review Committee, at their meeting of November 26, 1980, conducted
an Initial Study (IS-81-19) consisting of the review of applications for prezoning and
annex tion. The Committee concluded that the project, as proposed, would not result
in an significant negative effects on the environment and issued a "Conditioned"
Negative Declaration.
T e Committee conducted an additional Initial Study (IS-81-51) at their meeting of
July 1981 for the purpose of reviewing a proposal to subdivide and develop the subject
grope ty with 27 single family dwelling units. The Committee concluded that the proposal
would not result in any significant negative effects on the environment and issued
a "co ditioned'.a Negative Declaration.

General Plan and Zoning.
County's South Bay Community Plan designates the subject territory as medium
ntial (7.3 DU/Ac.), and County zoning is R-S-6 (Residential - single family, 5.8
). The City's General Plan designates the land as medium density residential
DU/Ac.). The City Council, at their meeting of February 3, 1981, adopted
nce No. 1933 prezoning the territory to R-3-P-8 (8 DU/Ac.).
Development plans.
0 November 3, 1981 the City Council adopted Resolution No. 10682 approving the
tenta ive map for the proposed development (Woodland Park). The approved map created
29 to s for the future development of 27 single family dwelling units and 2 open space
lots. The proposed development plans are consistent with the City's General Plan and
prezo ing classifications.
6.~ Municipal Services delivery.
T e City's Police, Fire, and Public Works Departments have determined that the
propo ed annexation and subsequent development of 27 single family dwellings will not
requi a additional manpower and/or equipment.
7. LAFCO action.
T e Local Agency Formation Commission conducted a public hearing for this proposal
at th it meeting of November 2, 1981 and adopted a resolution approving said proposal.
Pursu nt to Government Code Section 56271.1 and in accordance with LAFCO's resolution,
the C ty of Chula Vista has been authorized to initiate reorganization proceedings in
compl ance with Government Code Section 56430 et seq. and LAFCO's resolution.
8.~ Initiation of reorganization proceedings.
R organization proceedings consist of two Council actions, which are (a) Adopting
a res lution initiating reorganization proceedings and setting the time and date for
a not ced public hearing for the purpose of considering the proposed reorganization;
and ( ) conducting a public hearing at the time and date as specified, considering the
propo al, and taking appropriate action in compliance with the Government Code. In
accor ance with Government Code Section 56430(e) the City Council may, at the earliest,
condu t said public hearing at the regularly scheduled meeting of January 5, 1982.
FISCAII IMPACT
The C ty will receive property tax revenue from the proposal area based on the P~;aster
Prope ty Tax Exchange Agreement currently in effect between the City of Chula Vista and
the C unty of San Diego.
