Portion of Landis Avenue

At th December 3rd Redevelopment Agency meeting, the Agency authorized a financing
propo al for the development of a Marie Callender's Restaurant (parcel #3) within
the T wn Centre Focus Area. In furtherance of this project, staff will be proposing
that he Agency convey an 18,720 square foot parcel of property to the proponent by
mid-D cember (see Exhibit "1" for parcel location). To accomplish the conveyance,
it is necessary to vacate approximately seven feet of the easterly portion of Landis
Avenu beginning at "F" Street and extending 75 feet southward. (See Exhibit 1).
On Oc ober 27, 1981, the City Council adopted Resolution #10679 declaring its
inten to vacate portions of Madrona Street and Garrett Avenue, Landis Avenue,
Cente Street and a public alley (in Block 1, Map No. 820) within the Town Centre
Focus Area. A public hearing was held on November 17 and the Council directed
staff to bring back an appropriate resolution ordering the street vacations subject
to co currence by the utility companies.
There are no public utilities within the boundaries of this proposed street vacation
and t e subject vacation is in accordance with the provisions of the State of
Calif rnia Street vacation Act of 1941. Therefore, it is my
RECOM ENDATION: That the City Council
Adopt the attached resolution ordering the vacation of a portion of Landis Avenue
and a thorizing the City Clerk to record the subject document.

streets within the Town Centre - Townsite Tract
No. 2 Subdivision

A its meeting on October 27, 1981, the City Council adopted
R solution No. 10679 declaring its intention to vacate portions
o Madrona Street, Landis Avenue, Garrett Avenue, Center Street
a d a public alley in Block 1, Map No. 820, and setting November
1 1981, as the date for a public hearing to consider the
o dering of vacation of said streets. It is my
R COMMENDATION: That Council hold the subject public hearing and
d rect the City staff to return with a resolution ordering
v cation subject to concurrence by the utility companies
r garding reservation of easements.

D1~SCUSSION:
A part of a plan to resubdivide the downtown area bounded by
T ird Avenue, Garrett Avenue, "F" Street and Madrona Street, the
t ntative subdivision map proposed the vacation of certain
portions of street rights-of-way.
On August 26, 1981, the Planning Commission adopted Resolution
No PCS-81-1 recommending that Council approve the tentative map.

The closure of streets and alleys within the project
boundary will not adversely affect the adjacent public
improvements which have been designed to serve the proposed
development and avoid any serious health problems.
The vacated public streets and alleys will be replaced by
new easements for drainage, sewers, utilities and access.
Circulation - The adjoining streets are adequate to serve
the proposed development.
Approval of this tentative map is contingent upon vacation
of Garrett Avenue, Landis Avenue, Center Street, Madrona
Street and the alley in Block 1 as shown on Map 820 and
8357. These vacations or a schedule of such vacations shall
be approved prior to approval of the final map.

Co ncil incorporated these statements in its approval of the
to tative map on September 15, 1981.
Th City normally reserves easements for respective utility
co panies that have facilities within the vacated areas.
Ho ever, the City must obtain the necessary information on
loc tion and then write legal descriptions for easements.
The Comm unity Development staff is currently coordinating utility
rel cation with the utility companies. When the exact location
for the new easements are known, we'll return with the resolution
vac ting the street and offering utility easements.
An they item of note is that the westerly 50 feet of Garrett is
no being included in the vacation. It is being retained as
public right-~of-way for pedestrian access to Memorial Park.
I r commend approval of the request to vacate the subject streets
and alley, however, Council should delay adopting the resolution
ord ring the vacation until the utility easements can be defined
and reserved.
FISCAL IMPACT: Decreasd cost in street maintenance.
