The tract dated March 23, 1981, was awarded by Council Resolution 1 402 on February 24, 1981. This is one of four contracts a arded for the improvement of Memorial Park and consisted of e rthwork, concrete flatwork and other miscellaneous c nstruction. It is my R~COM MENDATION: That Council accept the contract work for D vision IV, Memorial Park Improvements. BpARD/COMMISSION RECOMMENDATION: N/A DXSCUSSION: T e project has been completed and a final inspection was made on 0 tober 14, 1981. All work has been completed in accordance with t e contract plans and specifications and to the satisfaction of t e City Engineer. A though all work was completed within the total approved c ntract cost amount (original contract cost - approved change o ders), there was extra work performed in the amount of $ ,759.27 that did not change the scope of the project. It c nsisted of importing additional fill material, recompacting, r forming and placing new column footings already constructed. T ere was a discrepancy on the plans of the difference in e evation between the building and the shuffle board courts. The L ndscape Architect, the Pekarek Group, worked from a topographic m p prepared for the City by Phillips-Reynolds Association. The b ilding was shown 1/2 foot high a..d the shuffle board court was 1 2 foot low creating a discrepancy of 1 foot. This discrepancy w s not discovered in the field by our inspection personnel until a ter the original work mentioned above had been nearly completed. A you will recall this project was bid twice as one contract and t en broken into four contracts and rebid. By doing that, we s ved approximately $100,000 in the contract costs. If the Page 2, Item 8 Meeting Date 11-3x81 project had been done by one contractor, the discrepancy probably ould have been discovered in time. There is risk involved in a ting as the general contractor, however, in this case the trade-off was that we saved $100,000 opposed to the error of $ ,759.27. T e extra work was not the fault of the contractor and the extra w rk should be approved. We believe there may be some liability o the part of the consultant, however, we will investigate that m tter further and return with a report.
