BIACKGROUND: 1. On June 10, 1981 the Planning Commission adopted a resolution recommending that the ity Council delete the conditional use permit requirement from Chula Vista's adult recre tion regulations. This action was taken at the behest of the City Attorney in resp se to a recent apellate court decision. 2. On July 7, 198'1 the City Council accepted the Commission's recommendation and, in response to a recommendation by the City Attorney, further moved that the proposed amend ent include the addition of drug paraphernalia shops as one of the uses regulated unde the adult recreation standards, as well as provisions which require the screening of t e display of adult-oriented materials from public view. Asa result of these modi ications, the Council returned this item to the Planning Commission for report and reco endation. B. f~ECOMMENDATION: • ncur with Planning Commission recommendation. C. PLANNING COMMISSION RECOMMENDATION: n August 12, 1981 the Planning Commission, by a vote of 4-1, recommended that Coun it adopt an ordinance amending the regulations to include drug paraphernalia shops as a ult recreation uses and providing for screening of adult-oriented materials from publi view, in accordance with Revised Resolution No. PCA-81-8. D. gISCUSSION he proposal now before the Council would accomplish the following three amendments to t e adult recreation regulations: ll. Delete the conditional use permit requirement for adult-oriented recreation uses, as previously endorsed by the Council. Add "Narcotic or drug paraphernalia shops" to those uses now regulated under the adult recreation provisions of the zoning ordinance. These provisions limit the establishment of adult-oriented businesses to the C-T zone; prohibit such establishments within 500 feet of residential districts, churches, schools, parks and playgrounds; and, require a minimum spacing of 1000 feet between individual adult-oriented businesses. Add an additional provision which would screen the internal display of adult- oriented material from public view, and prohibit the depiction or description • of such material on exterior signs, graphics or displays. The roposed amendments are consistent with the Council's earlier direction and their adop ion is recommended. ML:h Form A- 13 (Rev. 11/79)
