In Au ust 1976, the City Council place ximum vacation accrual limits on City employees.
In th ensuing years, the maximum limits have created difficulties for employees on
exten ed sick leave. The Civil Service Commission has examined the rules covering
maxim vacation accrual limits and eligibility for sick leave and vacation use, and
deter fined that these two rules can be in conflict. Therefore, a revision of subsection
(e) o Rule 2.02.8.2. has been proposed. It is my
RECOM ENDATION: That Council amend Civil Service Rule 2.02.B.2.(e) to allow for
accumulation over the maximum limit in cases of extended sick leave.

BOARD/COP~IMISSION RECOMMENDATION: At its meeting of September 10, the Civil Service
Commission voted unanimously to recommend that Civil Service Rule 2.02.B.2.(e) be
amend d to allow for accumulation over the maximum limit in cases of extended sick leave.
DISCU SION: Employees who have accumulated vacation up to or near the maximum have
an op ortunity to take vacation or, if the maximum is exceeded, forfeit further vacation
accru 1. In cases of extended sick leave, however, an employee cannot use the vacation
witho t forfeiting the use of sick leave. If sick leave is used, the vacation which
other ise would have been available for use is forfeited.
In or er to prevent the use of sick leave (when eligible) from conflicting with the
rule egarding maximum vacation accrual, a rule change is being recommended which
would allow accrual of vacation over the maximum limit when an employee is on
exten ed sick leave. The proposed rule, however, will require that the employee
reduc the excess balance to the appropriate level within six months after returning
to wo k or forfeit the excess accumulation.
The c ange will not affect employees who allow their vacation accumulation to exceed
the m ximum through oversight, and these employees will continue to forfeit any
vacation which accrues over the maximum.
