' On September 30, 1980, by Resolution No. 10275 Council approved the revised Tentat ive Map for Chula Vista Tract 80-20, Charter Point. The Final Map for Unit 1 of three units is now before Council for approva l. It is my RECOMMENDATION: That Council adopt resolutions as listed in the title hereto. BOARD/COMMISSION RECOMMENDATION: N/A DISCUSSION: The Final Map for Chula Vista Tract 80-20, Charter Point Unit 1, has been checked and found to be in conformance with the Tentative Map. Unit 1 consists of 104 condominium units on six common lots. Approval of the Final Map includes the acceptance of a street tree maintenance easement along Apache Drive; sewer, drainage and access easements within the common lots; the granting of Apache ~~~d~ A Page 2, Item ~( 9 Meeting Date 10-13-81 Drive for street purposes; an ~~Ye•~~cable offer of dedication of Lot A for open space; easements for pedestrian access, alley aprons and sidewalk ramps; a future street dedication; and an easement for grading purposes relative to construction of the future street. On July 20, 1981, the developers, Pacific Scenes, Inc., and Financial Scenes Incorporated, a joint venture, executed a document to grant an easement for street purposes for Apache Drive and Otay Lakes Road offsite of Unit 1. On August 11, 1981, the developers executed the subdivision improvement agreement. Said agreement includes public improvements within Unit 1 as well as improvements adjacent to the subdivision along Telegraph Canyon Road. The agreem ent also includes improvements offsite of Unit 1 for Apache Drive, and Otay Lakes Road. Appropriate surety has been posted for all said improvements. The developers have paid all fees and submitted all documents. In addition a $15,000 cash bond deposit has been provided to construct a future road way located within Unit 1 extending to the northwest. ("B" Street on the Tentative Map.) All conditions of approval applicable to unit 1 have been fulfilled except for no. 17. I recommend revising this condition, which provides for the completion of Telegraph Canyon Road prior to the occupancy of any units as follows: Prior to occupancy of any residences in either Unit II or Unit III and in any event within 5 years of the approval of the Final Map for Unit I, a four lane divided roadway to ultimate design and location (excluding median landscaping) from Station 69+50 as shown on Chula Vista Drawing 78-345D to the future location of Paseo Ranchero and a 57 foot wide roadway from Paseo Ranchero to Otay Lakes Road shall be completed. A faithful performance bond in the amount of $1,600,000 ensuring construction of said im provements to Telegraph Canyon Road shall be provided prior to recordation of unit no. 1 of Charter Point. Said im provements shall include but not be limited to 37 feet of pavement, curb and gutter each side of the "N" line as shown on Chula Vista Drawing 77-45D Station 71+00 to 77- 44D Station 98+50 (conceptual design), appropriate transitions as determined by the City Engineer and 57 feet of pavement, curb, gutter and A.C. dike from the end of the transition east to Otay Lakes Road. Drainage facilities shall }~e provided for both road way sections as determined by the City Engineer. Improvements within the segment from the future Paseo Ranchero east to Otay Lakes Road shall be situated in such a way as to provide ultimate improvements in the north half of Telegraph Canyon Road. ,l~j'- jUdbd I~ t. .. Page 3, Item X~X 9 Meeting Date l~(%~ 10-13-81 Council had agreed, at the time of approval of the Tentative Map, that if the developer was to build a pavement section 57 feet wide (curb to curb) between the Casa del Rey Subdivision and Otay Lakes Road, that this subdivision could proceed. It was understood that this was a considerable amount of offsite improvement and that a reimbursement agreement would be prepared to help repay the developer the cost of this extensive offsite improvement. Condition #17 required this offsite construction prior to occupancy of the units. The developer has been working on the p ans with that understanding. However, two things have developed which affect that original condition. 1. Recently, at the suggestion of Engineering Department staff the developer agreed to construct a divided roadway between Casa del Rey Subdivision and future Paseo Ranchero. This i~ beneficial to the City because the travel lanes will be at their ultimate location through that stretch. 2. The subdivision will be constructed in three units instead of one. Therefore the urgency to have the improvements constructed now has diminished. I believe it would not be justified to penalize the developer by holding up his Final Map for Unit 1 until the road is built. The change in scope of the offsite construction will be more costly to the developer and will require more tim e to modify the plans and right-of-way documents. Therefore, since all the units won't be built under one Final Map and since we can assure that the road will be built prior to occupancy of Unit 2, I recommend the modification to Condition #17. Plats are available for Council viewing. The developer has signed a separate agreement providing for the offsite portions of Telegraph Canyon Road.
