rive for street purposes; an irrevocable offer of dedication of
of A for open space; easements for pedestrian access, alley
prons and sidewalk ramps; a future street dedication; and an
asement for grading purposes relative to construction of the
uture street. On July 20, 1981, the developers, Pacific Scenes,
nc., and Financial Scenes Incorporated, a joint venture,
xecuted a document to grant an easement for street purposes for
pache Drive and Otay Lakes Road offsite of Unit 1.
n August 11, 1981, the developers executed the subdivision
mprovement agreement. Said agreement includes public
mprovements within Unit 1 as well as improvements adjacent to
he subdivision along Telegraph Canyon Road. The agreement also
ncludes improvements offsite of Unit 1 for Apache Drive, and
tay Lakes Road. Appropriate surety has been posted for all said
mprovements .
he developers have paid all fees and submitted all documents.
n addition a $15,000 cash bond deposit has been provided to
onstruct a future road way located within Unit 1 extending to the
orthwest. ("B" Street on the Tentative Map.)
11 conditions of approval applicable to unit 1 have been
ulfilled except for no. 17. I recommend revising this
ondition, which provides for the completion of Telegraph Canyon
oad prior to the occupancy of any units as follows:
Prior to occupancy of any residences in either Unit II or
Unit III and in any event within 5 years of the approval of
the Final Map for Unit I, a four lane divided roadway to
ultimate design and location (excluding median landscaping)
from Station 69+50 as shown on Chula Vista Drawing 78-345D
to the future location of Paseo Ranchero and a 57 foot wide
roadway from Paseo Ranchero to Otay Lakes Road shall be
completed. A faithful performance bond in the amount of
$1,600,000 ensuring construction of said im provements to
Telegraph Canyon Road shall be provided prior to
recordation of unit no. 1 of Charter Point.
Said improvements shall include but not be limited to 37
feet of pavement, curb and gutter each side of the "N" line
as shown on Chula Vista Drawing 77-45D Station 71+00 to 77-
44D Station 98+50 (conceptual design), appropriate transitions
as determined by the City Engineer and 57 feet of pavement,
curb, gutter and A.C. dike from the end of the transition
east to Otay Lakes Road. Drainage facilities shall be
provided for both road way sections as determined by the City
Engineer. Improvements within the segment from the future
Paseo Ranchero east to Otay Lakes Road shall be situated in
such a way as to provide ultimate improvements in the north
half of Telegraph Canyon Road.

~uncil had agreed, at the time of approval of the Tentative Map,
hat if the developer was to build a pavement section 57 feet
ide (curb to curb) between the Casa del Rey Subdivision and Otay
akes Road, that this subdivision could proceed. It was
nderstood that this was a considerable amount of offsite
mprovement and that a reimbursement agreement would be prepared
o help repay the developer the cost of this extensive offsite
mprovement.
ondition #17 required this offsite construction prior to
ccu anc~ of the units. The developer has been working on the
ans with that understanding. However, two things have
eveloped which affect that original condition.
. Recently, at the suggestion of Engineering Department staff
the developer agreed to construct a divided roadway between
Casa del Rey Subdivision and future Paseo Ranchero. This is
beneficial to the City because the travel lanes will be at
their ultimate location through that stretch.
The subdivision will be constructed in three units instead
of one. Therefore the urgency to have the improvements
constructed now has diminished.
believe it would not be justified to penalize the developer by
olding up his Final Map for Unit 1 until the road is built. The
hang a in scope of the offsite construction will be more costly
o the developer and will require more time to modify the plans
nd right-of-way documents. Therefore, since all the units won't
e built under one Final Map and since we can assure that the
oad will be built prior to occupancy of Unit 2, I recommend the
odification to Condition #17.
lats are available for Council viewing.
he developer has signed a separate agreement providing for the
ffsite portions of Telegraph Canyon Road. The agreement will be
resented to the Council at the meeting.
