Chula Vista D4unijcipal Code Relating to cardrooms SEGO~tD READING ANO ADOPTION SUBMITT D BY: Directo~ of Public Saf (4/5ths Vote: Yes No xx~ At the Council meeting~iof August 24, 198 the City Council accepted the re ort of the Director of Public Safety on the proposed modifications to the Cardroom Ordina ce and, with the exception of the future reduction of the number of licen~es from three to two in the event of revocation, direct d that an Ordinance be prepared reflecting the recommendations of the re ort. RECOMMENDATION: That the City Council consider the ordinance as prepared BOARD/COMMISSION RECOMN~ENDATION: N/A DISCUSSION: In my eport of August 24, 1982, I presented a detailed discussion of proble s relating to c rdroom operators and made several recommendations for ch nges in the Car room Ordinance.. In summary, these recommendations were a follows: Th t the number of Cardroom licenses be reduced from 4 to 3 and that an reference to population in determining the number of cardrooms be eliminated. 2. Th t the lottery system for selecting Cardroom operators be eliminated. 3. Al ow the cardrooms to stay open until 2:00 A.M. as opposed to the cu-rent practice of closing at midnight. 4. Al~.ow the cardroomsto be open on Sunday from 10:00 A.M. to 2:00 A.M. 5. Au horize the playi~g of the card game Panguingue. 6. Ra se the fees per stable from $30. per month to $60. a month. Ordin nce 359, adoptedl~5/10/46, repealed the preceding ordinances and presc ibed further regulations regarding ownership, license fees, hours of op ration, number o cardrooms permitted on Third Avenue between "E" and R osevelt Streets, and established other operating controls. Ordin nce 368, adopted 9/10/46, amended Ordinance 359 to further define the m aning of cardroo s and their owners, and also provided for inves igation of appli ants by the Chief of Police prior to Council consi eration for appr val of licensees. Ordinance 369, adopted'110/15/46, prohibited Sunday games. The 1962 Ordinance was the first ited as it is today. Ordina~ce 1305, adopted 11/3/70, provided a seven-year phaseout of all existi g businesses in December 1977. Ordina ce 1738, adopted in 1977, provided the following changes: 1. El'minated the sev n year phase-out provision provided in Or finance 1305, ad pted 11/3/70. 2. Pr vided for the licensing of one cardroom for every 25,000 re idents or any f action thereof. 3. Pr vided for the t ansfer or assignment of licenses subject to ra ification of th~ City Council. 4. Pr vided for a lottery system where new licenses, based upon the po ulation criteria, would be issued in the month of May each year, i f any . 5. Pr vided that licenses issued after the effective date of the am nding ordinance ,'I except those two already in existence, could ~o be transferred unless the licensee has been operating a ca droom for a full year at a fixed location within the City.
