Negotiat ons between the Police Officers Association (POA) and the International Association
of Fire fighters (IAFF) in 1982-83 progressed through imnasse, mediation with a State
Mediator and a final presentation to Council by the units without reaching agreement with
either u it. This was due to the lack of agreement over the 2% at 50 retirement plan issue.
As a ref ection of the City's concern for the general economic well-being of its employees,
the Coun it unilaterally granted a salary adjustment to both units. The mid-management
safety m tubers and the unclassified executive management position salary adjustments are
also inc uded herein for reasons discussed below. Therefore, it is my
RECOMMEN ATION: That the City Council adopt the resolution appropriating $ 287,950
as delineated in Exhibit A.

DISCUSS
The poli e and fire units have consistently maintained that if an agreement did not include
the ben fit of a 2% at 50 retirement plan they would not enter into a signed contract with
it As a result, due to the absence of a 2% at 50 plan in any City offer, the
apriation for compensation and fringe benefits contained herein is by unilateral Council
action. The total compensation for both units through unilateral action is 6.5%. With the
excepti n of the adjustments to compensation and fringe benefits, the City will proceed
through the 1982-83 fiscal year under the terms and conditions of the 1981-82 MOU's for
POA and IAFF.
The mid management safety positions of Battalion Chiefs, Fire Marshal and Police Captains
were no included in the City Council's previous action to appropriate funds for middle
manager inasmuch as if a different retirement benefit were awarded to the police and fire
units, he PERS retirement system would require that all sworn positions (including mid-
managem nt and executive management positions) be covered by the 2% at 50 plan. The plan
would t en be considered in lieu of any salary increase. Since the 2% at 50 plan was not
granted the sworn mid-management positions will receive the. same level of benefit as
other m d-managers, which was a total compensation of 7%.
On Octo er 19, 1982, when appropriating action was taken by the Council for the adjustments
to depa tment head salaries and benefits, adjustments for the City Manager, City Attorney
and Cit Clerk were not included. The following action includes those increases. In
additio due to the recent passage of Charter amendments, the salary and retirement
costs f r the Mayor will require an adjustment to reflect these additional costs.
