DISCUSSION: At the hearings held on September 28 and October l~, Council took testimony nn re ising the Master Fee Schedule as it relates to land development fees and on ce tain non-development-related fees. As a result of those hearings, Council di ected that the move to full cost recovery for development-related fees be ph sed in over a two-year period. In addition, Council indicated specific gu defines for non-development-related fres. The attached revised Master FeP Schedule reflects Council's instructions. The att~~rched tables indicate what le el of full cost recovery various fee groups wrill attain anri also the amount of annual revenue estimated to he received under the present fees (as re 1P.CtP_d in the Fiscal Year 198?-83 budget) and the annual revenue that cou~d he expected under the revised fee schedule. General government overhead has be n removed from the formula for full cost recovery and, therefore, when the to m full cost recovery is used in this agenda statement, it does not include ge eral government overhead. It should be recognized that the term "full cost • M Page 2, Item 10 Meeting Date 11 9 82 re overy rate" may be somewhat of a misnomer since the rate excludes not only ge eral government overhead costs but also some departmental overhead costs su h as staff meetings, map and record keeping, public assistance, etc. Th Parks & Recreation activity fees were recommended by staff and adopted by th City Council at 100q of full cost recovery, with the exception of the arts an crafts class which was adopted at 75~. These classes are somewhat unique in that they are conducted by outside contractors or officials who, for va ious reasons, may be replaced throughout the fiscal year. Since hourly fe s vary from one consultant to another, adjustments to activity class fees ar necessary from time-to-time in order to maintain a full cost recovery of ort. For this reason, the Master Fee Schedule reflects the percent of full co t recovery as adopted by Council, but the schedule does not identify the ex ct fee in dollars. This will allow the Parks & Recreation Department Di ector the flexibility to reasonably adjust fees without the need for re urring Council action and will satisfy to some degree the concerns ex ressed by department representatives. This is the process that has been us d in the past prior to the use of a full cost recovery formula. As staff indicated in the full cost recovery workshop, not all fees were re iewed in terms of full cost recovery. In an effort to expedite the full cot recovery program during FY 1982-83, those activities for which it was di ficult to document staff time or contained policy issues somewhat in • op osition to full cost recovery were deferred to the 1983-84 budget process. At that time, we will conduct an overview of the impact of the full cost re overy program and add to it any fees which previously have not been in luded. In addition to the attached htaster Fee Schedule, an ordinance revising various se tions of the Municipal Code has been attached for Council's approval. Th se ordinance changes are simply to ensure that ordinances do not contain s ecific fees but rather refer to the Master Fee Schedule, where appropriate. A the September 28 public hearing, Mr. Craig Beam, an attorney, requested t at the Master Fee Schedule be written in such a way as to allow Council the o tion of using private consultants rather than City staff in certain circumstances. As I explained in my agenda statement for the meeting of 0 tober 19, 1982, this is current practice and is not changed by full cost r covery fees. Mr. Beam had also requested that the Master Fee Schedule be w itten in such a manner as to allow negotiated fees (to be approved by C until) in special circumstances. It is the City Attorney's opinion that C until has that prerogative and can do so by approving a separate agreement w th a developer and, consequently, that such language is not required in the M ster Fee Schedule. W th the exception of those fees which are currently specified in the M nicipal Code, all of the fee changes in the Master Fee Schedule will be in e fect upon adoption of the resolution by City Council. For those fees which a e currently specified in the Municipal Code, the fee changes will be in • e fect on the 31st day after the adoption of the ordinance. It is important to note, however, that subdivision map processing is really th ee separate and distinct steps: tentative map approval, final map ap royal, and inspection of public improvements. If an applicant has paid fe s for any of these three phases, then that particular phase ~~ill he go erned by the fees in existence at the time those fees were paid. However, su sequent phases will be governed by fees in Pxistence at th? time the su sequent action i s taken. The fees for any Parks & Rer.,reation ac ivities/classes for which people have already signed up or which have been ad ertised will remain at the previously published level. However, new se signs vrill be charged in accordance v!ith the revised Master Fee Schedule. Th attached revised Master Fee Schedule indicates new text by underlining and deleted text by striking out. Portions of the Master Fee Schedule that mere no changed appear in plain text. The revised Fee Schedule as adopted will ha a the struck out portions deleted and the underlining will be removed.
