A cording to Section 15.04.285 of the Chula Vista Municipal Code, the owners m st enter into an agreement with the City before such a permit can be i sued. The Price Company has executed its portion of the agreement. It is my R COMMENDATION: That the Council adopt a resolution approving the subject a reement and authorize the Mayor to sign the agreement on behalf of the City. DISCUSSION: T e Price Company is in the process of developing its properties bounded by N ples Street, Oxford Street, Broadway and the Metropolitan Transit • D velopment Board railroad right-of-way (excepting the Harborside School p operty). A parcel map has been approved and recorded subdividing the p operty i nto four 1 ots. Two of the parcels have been bui 1 t upon (The Price C ub and the Price Bazaar). I order to provide for future development of Parcel 4, the owner proposes to i port approximately 23,000 cubic yards of fill. This is necessary to create a fairly level lot and to maintain positive drainage to the west. This fill i proposed to be brought in over a relatively long period of time. C nsequently, no compaction of the material is planned, due to the cost of m intaining compaction equipment on site. I accordance with the City's Grading Ordinance No. 1797, the owner is r quired to enter into an agreement to assure the City that the fill site s all be maintained in a safe and sanitary manner. The owner's private civil e gineer has completed a grading plan showing facilities to control s'ltation. The plan has been reviewed and approved by this department. I lieu of an overall landscaping plan, the City's Landscape Architect has p aced the following conditions in the subject agreement: 1~) piles of dirt created by dumping shall be leveled on a weekly basis and the fallow areas are to be seeded with rye grass each October 1st until filling operations are complete. ~- //CZS~ • i ii • • Page 2, Item 10 Meeting Date T1-j27$~ e site will be checked regularly to assure that the work is in accordance th the proposed agreement. We are requiring s bmittal of security in the amount of $5,000 to guarantee proper maintenance o the siltation retention facilities. S ides and a plat are available for Council viewing.
