HomeMy WebLinkAboutReso 1989-15440 RESOLUTION NO. 15440 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RATIFYING EXTENSION OF CONTRACT FOR PLANNING SERVICES OF MR. WILLIAM F. HEITER FOR THE CITY'S SIGN ABATEMENT PROGRAM AND APPROPRIATING NECESSARY FUNDS THEREFOR The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on April 12, 1989, the City Council authorized the employment of Mr. William F. Heiter as the contract senior city planner for the City's Sign Abatement Program, and WHEREAS, Mr. Heiter's contract of employment expired on December 31, 1989, and WHEREAS, the sign survey and analysis for "ol d Chula Vista" has been completed, and the survey for Montgomery has been substantially completed, and WHEREAS, it is estimated it will take twelve months to complete the analysis of the Montgomery sign survey, and conduct the follow-up actions required to cause the abatement of those signs identified through the aforementioned sign surveys as being ill egal/nonconforming, and WHEREAS, because of his in-depth knowledge of the Sign Abatement Program, it would be highly desirable to retain Mr. Heiter's planning services for the twelve month period from January through December, 1990, and WHEREAS, because it is now the midpoint of the budget year, it would be propitious to fund only the cost of the first six months of the contract from the General Fund and refer the remaining cost to the FY 1990-91 budget. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby ratify that certain extension of the Contract for Planning Services with Mr. William F. Heiter for the City's Sign Abatement Program, a copy of which is attached hereto and incorporated herein by reference as if set forth in full. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said contract for and on behalf of the City of Chula Vista. BE IT FURTHER RESOLVED that the sum of $12,000.00 be, and the same is hereby appropriated from the unappropriated balance of the General Fund to cover the cost of the contract for the six month period from January through June, 1990. Executed this 9th day of January, 1990. Resolution No. 15440 Page 3 FIRST AMENDMENT TO CONTRACT FOR PLANNING SERVICES Contract as entered into between Consultant Independent Contractor, MR. WILLIAM F. HEITER and the CITY OF CHULA VISTA, on April 12, 1989, by Resolution No. 14307 is hereby amended as follows: 1. Paragraph VIII TERM is amended by changing the date December 31, 1989, to December 31, 1990. 2. Paragraph IX COMPENSATION is amended to read as follows:: "The compensation to be paid by CITY to CONSULTANT for the work called for under this agreement shall be $25.00 per hour not to exceed a total of $24,000, of which $12,000 will be funded from a General Fund appropriation, with funding approval for the remaining $12,000 contingent upon its inclusion in the City's budget for the fiscal year 1990-91. CONSULTANT shall submit monthly invoices to the Director of Planning of the CITY. Payment shall be made to CONSULTANT within thirty {30) days. The CITY agrees to pay the total sum billed by the CONSULTANT each month for the duration of this agreement. The CONSULTANT shall not receive retirement benefits, paid vacations, or other fringe benefits." 3. All other terms and conditions of the previous agreement as ~xtended remain in full force and effect. IN WITNESS WHEREOF, CITY and CONSULTANT have executed this First Amendment to Contract for Planning Services this 9th day of January, 1990.
