HomeMy WebLinkAboutReso 1979-9572RESOLUTION NO. 9572 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA GRANTING OF APPEAL FOR TWO ARCO SERVICE STATIONS TO SELL PACKAGED BEER AND WINE The City Council of the City of Chula Vista does hereby resolve as follows: ir]HEREAS, the City Council has heretofore on April 17, 1979 held a public hearing to consider the appeal of two ARCO service stations from the Planning Commission decision denying permission to sell packaged beer and wine, and WHEREAS, after hearing the appeal, the following findings, as recommended by the staff, were made by the City Council: 1. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well being of the neighborhood or the community. 2. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. 3. That the proposed use will comply with the regula- tions and conditions specified in the code for such use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the appeal of two ARCO service stations be, and the same is hereby granted in accordance with the findings as set forth herein and subject to the following conditions of approval: 1. There shall be no exterior signs denoting the sale of beer and wine. 2. The addition of beer and wine shall be restricted as follows: a. Sales shall be limited to the area within the Mini-Shop at each station. b. Display shall be limited to one cooler box (approximately 5' wide x 7' high). c. Storage shall be limited to the enclosed storage room located adjacent to the P4ini-Shop (approxi- mately 7' x 14'). 3. Said amendment to the conditional use permit autho- rizing the sale of beer and wine shall be reviewed by the staff six months from the date of this resolution and a report made to the City Council as to any effects such merchandising may have had.
