RESOLUTION NO. 9558
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE SUBDIVISION P~IAP FOR
CHULA VISTA TRACT 79-06, CASA VERDE
The City Council of the City of Chula Vista does hereby
resolve as follows:
laHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a sub-
divisioxi to be known as Chula vista Tract 79-06, Casa Verde
and has recommended that the City Council approve said tentative
map subject to the conditions contained in Planning Commission Reso-
lution No. PCS-79-6 adopted on the 28th day of March
1979, a copy of which is attached hereto and by this reference made
a part hereof, the same as though fully set forth herein, and
WHEREAS, the proposed project is exempt from environ-
mental review as a class 1(k) exemption.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Chula Vista does hereby approve said tentative
subdivision map in accordance with Planning Commission Resolution
No. PCS-79-6 (Revised).

RESOLUTION OF THE CITY Pi.ANNING COMMISSION RECOMMENDING TO
7HE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP FOR CASA VERDE
WHEREAS, on February 1, 1979 Ray Burgess submitted a revised tentative
subdivision map for the conversion of an existing six unit apartment into a one
lot condominium project to be known as Casa Verde, at 295 "D" Street in the
R-3-G zone, and
WHEREAS, Section 66473.5 of the Government Code provides that approval of a
subdivision map shall be based upon findings of consistency between the subdivision
map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose, was
given by the publication in a newspaper of general circulation in the city at
least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
P1arch 28, 1979 in the Council Chamber before the Planning Commission and said
hearing was thereafter closed, and
WHEREAS, the proposed project was determined to be exempt from environmental
review as a Class 1(k) exemption.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Planning Commission, the Commission finds
that the revised tentative subdivision map known as Casa Verde, Chula Vista Tract
79-6, is consistent with the goals and objectives of the Chula Vista General Plan
based on the following:
a. The conversion of apartments into a condominium does not affect the
following elements of the General Plan: Land Use, Circulation,
Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes,
Public Buildings, Conservation, Parks & Recreation and Open Space.
b. Housing Element - While the conversion of apartment units into condo-
miniums will reduce the inventory of rental housing, it will also
permit an expanded choice of housing ownership.
2. The Planning Commission recommends to the City Council that the revised
Tentative map for Chula Vista Tract 79-6, Casa Verde, be approved, subject to the
following conditions:
a. The owner shall grant to the City an easement for street purposes
at the corner of Third Avenue and "D" Street fora property line
q!~J ~ return radius of 10 feet.
b. The owner/subdivider shall construct a sidewalk ramp at the curb
return of Third Avenue and "D" Street prior to approval of the
final map. An engineering construction permit shall be obtained
to construct the sidewalk ramp.
c. The owner shall comply with all applicable sections of the Chula Vista
~1unicipal Code prior to approval of the final map.
d. The Building Department will not issue a certificate of occupancy
until the project conforms to the condominium ordinance requirements
and the carport construction is complete.
3. That this resolution be transmitted, along with the tentative map, to
the City Council, and a copy of this resolution be transmitted to the applicant.
