HomeMy WebLinkAboutReso 1979-9556A RESOLUTION PdO. 9556 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE SEWER MAINTENAPdCE POLICY AS PRE- VIOUSLY ADOPTED BY RESOLUTION NO. 4377 ACCEPTING THE LIABILITY ON THE PART OF THE CITY FOR ANY BILLS BOTH IN RELIEVING AND DETERI`ZIPdIDIG THE CAUSE OF ANY SEWER STOPPAGE IF SAID STOPPAGE IS FOUND TO BE IN THE SEWER MAIra The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City has received numerous complaints for circumstances wherein property owners have called licensed sewer cleaning firms in the event of a sewer stoppage and said firms have responded and found that the stoppage causing problems to the pro- perty owner was located in the sewer main and not in the sewer lateral, and WHEREAS, under said circumstances, the City has refused any responsibility for the cause of making such determination, and WHEREAS, since the City has now fully assigned all respon- sibility for the cleaning and maintenance of sewer laterals to the property owners, it is deemed reasonable to accept the cost of the determination of the location of such stoppage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the sewer maintenance policy as expressed in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full, be, and the same is hereby adopted. Therefore, maintenance of sewer laterals has now been assigned to the property owners and only the maintenance of sewer mains is assumed by the City and is the responsibility of the City. PURPOSE ~ :~. f ~ F,. ~, Establishing sewer .lateral maintenance policy. ~~ `.j '~'~~" ' POLICY The following sewer lateral maintenance policy is hereby adopted • by the City Council. 1. The maintenance of the sewer lateral from the main line to residence shall be the responsibility of the property owner. 2. If a stoppage occurs, the property owner shall be responsible for determining through the use of a licensed cleaning service or a licensed plumber using adequate power driven equipment with root cutters, the location of said stoppage, i.e., whether the stoppage is in the lateral or in the main. 3. If the stoppage cannot be cleared by a licensed sewer cleaning service or licensed plumber using adequate power driven equip- ment with root cutters, the licensed firm may contact the Department of Public Works, Street Division, for assistance providing the equipment used remains on the job. 4. The City will render such assistance to the licensed firm as deemed necessary by the Director of Public Works. The City will not charge the property owner for their assistance, except if it is established that the stoppage was caused by materials deposited into the sewer from the property it serves; in which case the City will charge for the assistance rendered. If it is determined by the City after such assistance to the licensed cleaning service that the stoppage was clearly not in the sewer lateral, but was located in the sewer main, the City will assume liability for bills or other expenses in- curred by the property owner through the use of such a licensed cleaning service in relieving or determining the cause of the stoppage; provided, further, that in the event the stoppage occurs in the lateral within the public right of way as a result of street tree roots, the City will re- place the lateral at its expense in accordance with City Policy Number 200-05. 6. If sewer laterals must be relocated due to the construction of projects sponsored b_y the City, the City will bear the cost of this relocation. 7. The property owner shall enter into an agreement on the designated form with the City for such services, and must reimburse the City as set forth in the Master Fee Schedule. 4 If it is determined by the City after such assistance that the stoppage was clearly not in the Y~~~~; lateral, but was located in the sewer main, the City will assume liability for bills or other expenses incurred by the property owner through the use of such a licensed cleaning service in relieving or determining the cause of the stoppage; provided, further, that in the event the stoppage occurs in the lateral within. the public right-of--way as a result of street tree roots, the City will replace the lateral at its expense in accordance with City Policy Number 200-OS 5 If sewer laterals must be relocated due to the construction of projects sponsored by the City, the City will bear the cost of this relocation. 6.
