RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA OPPOSING SENATE BILL N0. 462 REQUIRING
STATEWIDE REGULATION OF BILLBOARDS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the appearance of a community and the health,
safety and welfare of its inhabitants is solely a matter of local
concern, and
WHEREAS, regulation of outdoor advertisement can have a
direct effect on the appearance of a community, which thus impacts
the economy and the welfare of its citizens, and
WHEREAS, the unique characteristics of communities through-
out California require individualized zoning treatment, and
WHEREAS, statewide regulation of signing and outdoor
advertisement cannot adequately deal with local needs, and
WHEREAS, abatement of nonconforming uses through the
exercise of the police power with a period of amortization has been
recognized by municipalities and the courts as a reasonable proce-
dure for many years, and
WHEREAS, the elimination of said right of cities without
remuneration to the property owner would have a serious adverse
impact on the economy of cities desiring to enhance their environ-
ments, and
WHEREAS, the hereinafter proposed legislation would provide
a windfall to one particular type of property owner without any
reasonable justification therefor, and
WHEREAS, the Supreme Court of the State of California has
recently approved abatement with amortization as a constitutional
and lawful means of eliminating nonconforming uses, and
WHEREAS, Senate Bill No. 462 (Zenovich), by requiring
statewide regulation in the area of outdoor advertisement would
severely limit the ability of a city to deal with its particular
(zoning) problems and would constitute an unwarranted interference
with matters of local concern, and an invasion of local police powers.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby register its strong opposition
to Senate Bi11 No. 462 (Zenovich) which would interfere with local
home rule options which have been repeatedly upheld by the courts
and the legislature for many years in the past.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be and she is hereby directed to forward certified copies
of this resolution to the members of the San Diego County Legislative
Delegation and to other appropriate representatives in the Legislature.
