HomeMy WebLinkAboutReso 1979-9540~ y RESOLUTION NO. 9540 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION P7AP FOR CHULA VISTA TRACT 79-15, VILLA SAN MIGUEL The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declara- tion, IS-76-41, and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Chula Vista Tract 79-15, Villa San Miguel and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-79-15, adopted on the 28th day of February, 1979, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein, and WHEREAS, the City Council requested that certain changes be made in the conditions of approval as recommended by said Plan- ning Commision Resolution No. PCS-79-15 and a copy of said changes are attached hereto and by this reference made a part hereof. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative subdivi- sion map based upon the findings in Planning Commission Resolution No. PCS-79-15 and subject to the conditions attached hereto. City Clerk ~-- cc-sso_ ~'~' 1. The tentative map shall be revised to show the following additions 'or corrections: a. A 4-foot monolithic curb, gutter and sidewalk shall be provided along the entrance road on the south side of Lion Circle (approximately 631 feet). b. Revise the typical section of the entrance road to show P.C.C. curb instead of 6" A.C. c. Revise the easterly end of the entrance road to provide turn-around capabilities subject to the approval of the City Traffic Engineer. d. Provide detail drawings showing transition from the entrance road to the loop road adjacent to Lot #1, subject to approval of the City Engineer. e. Show the proposed sewer easement entering the subdivision from Eucalyp- tus Court or Bonita Glen Drive to be 10 feet in width rather than 15 feet. f. The sewer main behind lots 4 and 5 shall be constructed to the westerly subdivision boundary, terminating with a manhole and a stub for adjacent property owners to tie into at some time in the future. Said stub shall be within the subdivision boundary. 2. Streets. a. At the intersection of Lion Circle and Hilltop Drive a minimum curb radius of 20 feet shall be used at both the north and south returns. A preliminary improvement plan showing how the north return can be constructed while maintaining access to the adjacent property from Hilltop Drive shall be submitted to the Engineering Department for review. Wheelchair ramps are to be constructed as required by the City Engineer. b. An acceptable turn-around design shall be provided near the east end of Lion Circle as reflected in condition l.c. c. Where overlay of existing pavement is proposed on Lion Circle, said road shall be cored to determine if it conforms to the minimum structural section (2 inches A.C. on 4 inches Class II aggregate base, or more if the required "R" value test shows a need for a thicker structural section; the exact section to be determined by the City Engineer). A note shall be placed on the final improvement plans to reflect this requirement. ~~~~ 2• 3. Sewers. a. All lots are to be served by gravity sewers. b. The developer shall pay all appropriate sewer connection charges and fees. c. The proposed sewer easement entering the subdivision from Eucalyptus Court or Bonita Glen Drive shall be 10 feet in width rather than 15 feet. d. The sewer main behind lots 4 and 5 shall be constructed to the subdivision boundary, terminating with a manhole and a stub for adjacent property owners to tie into at some time in the future. Said stub shall be within the subdivision boundary. 4. Drainage. The surface drainage as well as all drainage facilities onsite and offsite are subject to approval by the City Engineer. The applicant shall be responsible for installation and acquisition of any offsite right of way or easement required for underground drainage extending to a public street. Underground drainage shall be provided in accordance with the drainage study submitted by the applicant. The developer and his successors in interest shall enter into an agreement to hold harmless and indemnify the City from any liability resulting from drainage from this development to neighboring properties. Developer further agrees to defend the City in any lawsuit brought for this purpose. 5. Grading. a. Retaining wall details will be required as part of the grading plan. b. All grading shall be done in accordance with the City of Chula Vista Landscape Manual and the Grading Ordinance (No. 1797). 6. Traffic a. The developer shall pay his proportionate share of the cost of installing traffic signals in accordance with the adopted Council policy for traffic signal participation. b. The developer shall install street lights along Lion Circle, the number and location to be determined by the Traffic Engineer. The location, type and material shall be subject to approval by the Traffic Engineer. 7. Miscellaneous. a. The developer shall install an irrigation system in the median island as~~ 3. in Lion Circle and the maintenance of this area shall be the responsibility of the homeowners association. The owner shall enter into an agreement with the city of Chula Vista wherein the owner agrees on his own part or on the part of his successors in interest that the maintenance of the median island in Lion Circle shall be the responsibility of the homeowners association for the Villa San Miguel subdivision. The City of Chula Vista shall retain the right to modify the median island in the event such becomes necessary for traffic safety and circulation. The developer shall give the City an irrevocable offer of dedication for the entrance road. b. The subject property must be annexed to the city of Chula Vista prior to approval of the final map. c. If necessary, the developer may request the City Council to authorize the City to exercise its power of eminent domain to acquire right-of-way, if required, for the sewer and/or drainage easement entering the subdivision from Eucalyptus Court and/or Bonita Glen Drive. This shall be done prior to approval of the final map. d. The developer shall comply with all of the requirements of the City of Chula Vista Municipal Code as it pertains to this subdivision. Final map and improvement plans shall be prepared in accordance with the City of Chula Vista Subdivision Manual. e. The developer is required to pay the Residential Construction Tax of $375.00 per unit plus $25.00 for each bedroom over one. f. The developer is required to pay Park Acquisition and Development Fees of $130 per unit plus $100 development costs per unit for a total of $230 per unit (20 X $230 - $4,600.). g. Prior to the acceptance of the street improvements, the developer shall request that the City pass a resolution to enforce the Vehicle Code on the private street and designated guest parking areas. g~yo
