(4/5ths Vote: Yes X No ) 0 September 28, Council adopted a resolution setting October 26 for a public h aring to consider the necessity of condemning property for the construction o Telegraph Canyon Road. Therefore, it is my COMMENDATION: That Council conduct the public hearing and adopt the solution ordering the condemnation. COMMISSIONS RECOMMENDATION: N/A DISCUSSION: T e City Council has budgeted funds in last year's budget for the widening of S T legraph Canyon Road between Hilltop Drive and Melrose Avenue. This will i clude providing curb and gutter on the north side of the street between Hilltop Drive and Hilltop Vista Subdivision, providing curb and gutter on the s uth side of the road from Mel rose westerly to the existing homes. This wil 1 p ovide for two travel lanes and two bike lanes in the street for the entire 1 ngth, plus a parking l ane adjacent to the homes at the westerly end of the p oject. T e segment of the roadway that crosses Mr. O'Brien's property (see attached etch) was built by the County many years ago. It is meant to provide two 1 travel lanes only with no bike lane or curbing. According to our records, e right-of-way was never purchased or dedicated. It is our position that we h ve prescriptive rights to the paved portion of the roadway across r. O'Brien's property, however, we need additional right-of-way in order to rovide the full street section, i.e., bike lanes and transition across his roperty. We do not propose to condemn right-of-way for a parking lane across is property. here are in excess of 3,000 vehicles per day traveling along this roadway, lus bicycle and pedestrian traffic. The project has been approved by the ity Council for construction and it is my recommendation that the Council ind that the public interest and necessity require the acquisition and taking f this certain real property for a street right-of-way. ISCAL IMPACT: The property will be acquired with Gas Tax revenues. • owever, at this time an appraisal has not been performed and we do not know he cost.
