Ordinance ~QQ - Amending Section 18.12.140 of the Municipal Code
relating to the time of expiration of tentative maps and the
extension of tentative maps

On June 11, 1982, the Governor signed an emergency bill amending
th State Subdivision Map Act Section 66452.6 which established a
ne time frame for the life of an approved or conditionally
ap roved tentative map as well as a new time frame for the
ex ension thereof as established by ordinance of local commun-
it es. Tentative maps will now run for 36 months with the
po sibility of an extension for an additional 36 months. The
Co my of San Diego and other communities are taking steps to
co form to the new provision of the Subdivision Map Act.
RE OMMENDATION: Adopt the ordinance
BO RD/COMMISSION RECOMMENDATION: N/A
DI CUSSION: Our existing Section 18.12.140 of the subdivision
or finance is woefully outdated and no longer conforms to the
re uirements of the State Subdivision Map Act. Although this is
eq ally true of many other provisions of the Act, the City
• At orney's office is still in the process of reviewing the rather
le gthy draft prepared by the Engineering Department and probably
wi 1 not have a completed revision of the City's subdivision
or finance prepared for Council action until late in October. The
dr ft will also be reviewed again by the Engineering Department
an the Planning Department so that it may well be that a complete
re ision will not be available until some time around the first of
th year.
In the meantime, there are a number of existing approved or
co ditionally approved tentative maps which should be subject to
th latest revisions of the State Subdivision Map Act. Recog-
ni ing the current state of the economy, the State has acted on an
em rgency basis to provide a 36 month period for the life of an
ap roved or conditionally approved tentative map and authorized
to al communities to grant extensions for up to an additional 36
mo th period. At the present time, the life of the map is only
tw years and an extension may be granted for not more than a
ma imam of two years.
Th State in AB 1668 established the following facts necessitating
su h an emergency bill "in order to permit cities and counties to
pr serve development applications which are about to expire and
which cannot presently be processed due to prevailing adverse
ec nomic conditions in the construction industry, it is necessary
th t this act take immediate effect." The County of San Diego has
• en cted enabling legislation and other cities will undoubtedly act
i ediately as well.
