TLE: Ordinance ~ p ~ ~ Amending the Open Space Chapter 17 of the Municipal Code SECOND RE,SI?Ii~sG AND T~~°~~Ti~N ED BY: Director of Parks and Recreatio n r~ ) (4/5ths Vote: Yes X No At the ugust 17, 1982, Council meeting staff was directed to prepare amendments to the Open Sp ce Chapter of the Municipal Code in accordance with recommendations submitted. Therefo e, it is my; RECOMME DATION: That the Ordinance be placed on first reading. BOARDS/ OMMISSIONS RECOMMENDATIONS: N/A DISCUSSION: 1. Section 17.08,460 (Paragraph "A"' shall be added to this section) his section gives City's Engineering Department authorization to issue e croachment permits to open space district homeowners wishing to maintain • a maximum 20' firebreak and/or an upgraded landscape on property adjacent a d touching the homeowner's property line. Applications for this encroach- m nt will be exempt from the $100 fee payment described in Section 17.08.480 o the Code. 2. S ction 17.08.520 A thorizes the establishment of a new section in the Open Space Chapter that a lows a maximum reserve of 50% of the previous year's operating budget. T is amount is to accumulate on a gradual basis and will be in full compliance f ve years from date of enactment. New Districts will be allowed 5 years to a cumulate the required reserve. 3. Section 17.08.530 T is section describes each district's authority to elect an advisory board c mposed of five property owners within a district. This advisory board may m ke recommendations to the Parks and Recreation Department with respect to t e maintenance and operation of the open space districts.. Members of the b and shall serve without compensation and shall hold office fora term of t ree years from the date of their appointment. Board members' length of t rm shall be three years. Members may serve a maximum of two, three-year s cceeding terms. Staggered terms shall be achieved by the initial members d termining those members who will serve less than three years. This petition shall be filed with the City Clerk. An election must be held within the district at a predetermined site within sixty (60) days. Notification and verification of the homeowners eligibility to hold office must be included with notification of election to all homeowners within the district by mail. The election will be accomplished by the individuals interested in initiating the district or by current board members to replace persons on the board whose terms have expired or re- signed. All votes must be tabulated in a legal method and filed with the City Clerk.
