DIS USSION: In June of 1976, Gerald Baker, owner of the property lying
bet een I-5 Freeway and Industrial Boulevard and north of "L" Street applied

the right-of-way in fee, it was found that the title was clouded and that the
mat er would have to be judicially decided.

Planning Commission then recommended approval of the vacation of all that

~ing before the Council on January 25, 1977, staff recommended against the

isit Development Board (MTDB). The matter was then filed until a response

In ~ebruary of 1979 the City received a letter from MTDB stating that the
rig t-of-way was not needed by them and there was no objection to the vacation.
The matter was then renewed and another public hearing held on March 4, 1980.
At hat time Caltrans expressed an interest in using the right-of-way for a
Par and Ride lot. The matter was again filed.
As result of that action taken by Caltrans, the City and Caltrans have been
inv lved in litigation with the property owner. To settle the matter,
Cal cans has agreed to release its interest in the northerly 794 feet of
rig t-of--vay so that we may vacate that portion.
At is meeting on August 18, 1982, Council adopted the resolution of intention
to vacate that right-of-way and set September 7 as the date for a public
hea ing on the matter.
In ccordance with the Street Vacation Act of 1941, the street may be vacated
now that there is no present or future need for the subject portion of
Ind strial Boulevard.
Tlii order of vacation, i f approved, has no bearing on who thi s property wi 11
rev rt to. The matter will be settled after the vacation is complete.
The only utilities within the subject right-of-way are Pacific Telephone lines
and a public sewer line. Arrangements have been made to reserve easements for
the e facilities. The other utility companies have responded with no
obj ctions.

Dear Mr. Pfister:
I am returning the two copies of the Agreement which you sent
to the Port. We are unable to recommend paragraph 5 -Workers'
Compensation, as written, to our Board inasmuch as it leaves an open-
ended liability to the District.
It is our understanding that Chula Vista is self-insured on
workers' compensation. The District is covered by the State Compen-
sation Fund and currently our rate for gardeners is 7.26$ of the
gardeners salary. If you would adjust your labor rates to reflect this
increase rather than have paragraph 5, we would recommend it to our
Board.
