The owner has executed his portion of the Grant of Easement form and it is now ready for acceptance by the City. It is my RE OMMENDATION: That the City Council accept subject right-of-way and di ect the City Clerk to forward the Grant of Easement to the County Recorder fo recordation. BOI~RDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Re ently Mr. Charles A. Buttner, owner of the property at the southeast corner of Broadway and "L" Street, applied for a building permit to replace the ex sting gas station with a garage and carwash facilities. In accordance with Se tion 12.24.010 of the Chula Vista Municipal Code, the owner must upgrade th public improvements to current City standards. On item noted is that the existing curb return at the corner has only a 20' ra ius. Our current standards call out a minimum of a 30' radius for a major in ersection such as this. Up n investigation, it was found that reworking this curb return would require re ocating one existing traffic signal and installing one new one. Imposing th's requirement would result in undue financial hardship to the owner. ever, we sustained the requirement to dedicate sufficient right-of-way to ommodate the future construction of a new curb return. This is also in ordance with Section 12.24.010 of the City Code. h f A 0 Buttner has agreed to this dedication (totaling 85.84 sq. ft.). He has his engineer prepare the legal description and plat. The data has been nd to be satisfactory by this department. The Grant of Easement has been perly signed and notarized.
