At 2:00 p.m. on April 7, 1982, in the City Council Chambers, the City Engineer
received sealed bids for the Construction of Grading and Drainage Improvements
for East "H" Street in the City of Chula Vista, California. The scope of the
proj ct includes the grading of a minimum of 44 feet of right-of-way, removal
and recompaction of alluvium deposits, the installation of storm drain
facilities and slope landscaping.
The onstruction of these improvements will be the first step on the extension
of ast "H" Street from the Hidden Vista Subdivision easterly boundary to a
poin west of Buena Vista Way. These improvements will be constructed in
acco dance with the East "H" Street Development Program (approved by the City
Coun it on January 6, 1981, by Resolution No. 10371) and the accompanying
enab ing agreement. The parties to this agreement are: the City of Chula
Vist El Rancho del Rey Corporation, Otay Land Company and Roll Investments.
Each party will contribute cash, services and/or agrees to reimburse funds at
a fu ure date. It is my

Approve the agreement;
Appropriate $789,844 from the unappropriated balance of Gas Tax Funds
and transfer from:

CA in the amount of $1,178,440.05.

DIS USSION:
A r ement
Since May 19, 1981, when the Council expressed a desire to accelerate in the
eas erly extension of East "H" Street (Phase I) from the Hidden Vista
Subdivision to near Buena Vista Way, we have been pursuing the realization of
this project. Our efforts have been coordinated with those of the El Rancho
del Rey Corporation, Otay Lane Company (The Gersten Company), Roll Investments
and ther developers in the area.
The Gersten Company prepared the grading and improvement plans necessary for
the onstruction of the Phase I East "H" Street roadway improvements (2 travel
lane ). They have caused the relocation of a 69KV transmission line which
inte fered with project construction. In addition, at no cost to the project,
they have executed an Easement Deed dedicating to the City the ultimate East
"H" Street right-of-way as well as provided a borrow site from where the
road ay fill can be obtained.
The Gersten Company total monetary contribution towards the construction of
this project is set at $469,000. To date, they have spent about $242,000 for
the preparation of grading and improvement plans necessary for the
cons ruction of the East "H" Street roadway and the relocation of a 69KV
trap mission line which interfered with the construction of the project.
Thei remaining contribution (about $227,000) will be used to provide
supp rtive professional services during the construction of the project. The
serv ces which they have agreed to provide include: soils engineering/

geo ogist, soils testing, surveying and a paleontologic monitor. The
acc mpanying agreement lists all the services/responsibilities that the
Ger ten Company have agreed to provide during and after the completion of the
pro ect.
Easement Deed
The Gersten Company at no cost to the City, has granted an easement for street
and drainage purposes to the City of Chula Vista for the ultimate right-of-way
wit in their properties. There is a deed restriction in this easement that is
irr guaar and one that would not normally be accepted by the City. That deed
res riction states that the City will not grant permission to any utilities to
ins all facilities within the right-of-way. The reason for that restriction
is hat the Otay Land Company is in a condemnation suit by the Otay Water
District for an easement for pipeline purposes to serve Hidden Vista Village.
The Gersten Company is not willing to dedicate the right-of-way without this
rest iction until such time as the condemnation action is completed.
This means that the City will not be able to give franchise rights to other
utilities. Gersten has informally agreed that such time as the area begins to
deve op "H" Street would then be dedicated on the subdivision map or by
sepa ate deed as a normal right-of-way. Their position is that if the area is
not eveloped then utilities would not need to install facilities, therefore,
this restriction should not cause any inconvenience to either the City or
othe utilities.
The isk that we are concerned with is that if a utility such as the telephone
comp ny or SDG&E were to condemn an easement within "H" Street, we have a
ques ion of who would have to pay for a utility relocation in the future
shou d the grade or other changes be made to "H" Street which would require
re to ation of utilities. I believe that since our facilities will be there
firs we 1) have certain prior rights and 2) would have controls on where the
util ties put the facilities. Therefore I believe the risk would be very
mino if any, by accepting the terms of the easement. I have checked with the
City Attorney and he agrees with me on this matter.
Award of Contract
On A ril 7, 1982, the City Engineer received bids for the Construction of the
East "H" Street (Phase I) Improvements from the Hidden Vista easterly
subdivision boundary to near Buena Vista Way (a distance of about 9640 linear
feet). These Phase I improvements consist of grading a minimum of 44 feet of
righ -of-way, partial installation of drainage improvements, the paving of two
trav 1 lanes (30 ft. width), and installation of curb, gutter and guard rail.
Due o the nature of the improvements and potential cost reductions, we
decided to separate the job into two contracts. Contract 1 consists of
grading and installation of drainage improvements. Contract 2 consists of the
paving of two lanes and installation of the remaining surface improvements.
Bids or both contracts were opened on April 7, 1982.

The bids received (for both contracts) were substantially lower than the
Eng peer's construction cost estimates and could result in a total savings of
$61 ,767 ($2,309,905 total Engineer's estimated cost vs. $1,695,138 total bid
amo nts). Tonight, however, I propose that Council accept bids for Contract
Num er 1 only and that the contract be awarded to the apparent low bidder,
Sig s & Pinnick Inc. of E1 Cajon, with a bid of $1,178,440.05. Bids for
Con ract Number 1 were received from 11 contractors as follows:

The low bid by Signs & Pinnick Inc. for Contract Number 1 is below the
Engi eer's estimate of $1,546,000 by $367,559.95 or 23.77%. We have reviewed
the ow bid by Signs & Pinnick Inc. and have found it to be acceptable.
The id for Contract Number 2 contains a provision which states that award of
the contract (if made) may not be done before July 1, 1982, and would be
away ed within 120 days after the opening of the bids. The final date on
whic Contract 2 can be awarded is August 5, 1982. This provision was
incl ded in the bid document in order to:
provide time for the City to ascertain fund availability to award the
contract and
provide time for the completion of Contract 1 construction.
I wi 1, therefore, request City Council action on Contract 2 on or before
Augu t 5, 1982.
FISC/~L IMPACT:
To ward Contract Number 1 will require that the City appropriate the
remaining Gas Tax fund balance and delay several previously Gas Tax funded
proj cts. The tables below will familiarize Council with the fund
availability and fund requirement to award the contract. Information on these
tabl s show both the City commitment to this project in terms of dollars, and
its impact on City fund balances and postponed projects.
