BA KGROUND 1. This item involves a request to rezone approximately 6 acres located between North ourth and North Glover Avenues, immediately north of the Department of Motor Vehicl s from C-C (Central Commercial) to I-L (Limited Industrial). 2. On April 27, 1982 the City Council approved an amendment to the General Plan changi g the land use designation of the subject property from "Retail Commercial" to "Resea ch and Limited Industrial" and adopted a conditioned Negative Declaration issued on IS- 2-22 for the amendment. No further environmental review is required with this applic tion. Council also directed that the application for a conditional use permit to allow he distribution center be made subject to Council's approval as well as the Planni g Commission's approval. B. Proposed zone boundary. The applicant intends to file an adjustment plat which would consolidate the four cels into two parcels. The smallest parcel will be located adjacent to North Fourth venue nd will have a lot depth of 200 feet (along Brisbane Street) and a street frontage of appr ximately 160 feet on North Fourth. Due to the property's adjacency to both commercial and indus- trial zones, either of these zones would be appropriate. Because of the general lack of expos re to a major street (North Fourth Avenue) of the majority of the property, light Indus rial uses seem much more appropriate. In addition, since most light industrial uses ypically generate less traffic than commercial uses, it would be more compatible with he adjacent mobile home park to the east. 5~. Proposed development. 0 April 28, 1982, the Planning Commission approved a conditional use permit for Big B ar Markets to establish a distribution and warehouse facility on the larger parce (5.2 acres) contingent upon the property being zoned industrially. 6. Conformance with the General Plan. A proval of the rezoning will achieve consistency with the General Plan designation of "R search and Limited Industrial" established on the property by the City Council on April 27, 1982. 7 At the request of the Council, the City Clerk appealed the Planning Commission decis on on the conditional use permit for Big Bear Markets. PCZ-82-E • • • RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE REZONING OF APPROXIMATELY 6 ACRES AT 45 NORTH FOURTH AVENUE FROM C-C TO I-L WHEREAS, a duly verified application for the rezoning of property was filed with the Planning Department by Title Insurance and Trust Company on ~bruary 17, 1982, application No. PCZ-82-E, and 6 WHEREAS, said application requested a change of zone for approximately acres at 45 North Fourth Avenue from C-C to I-L, and WHEREAS, on March 10, 1982 the City Planning Commission adopted Resolution A-82-1 recommending a change in the General Plan of the designation of the subject property from "Retail Commercial" to "Research and Limited Industrial," d WHEREAS, a conditionbd Negative Declaration issued on IS-82-22 on the ral Plan Amendment, GPA-82-1, was adopted by the Planning Commission on rch 10, 1982, and WHEREAS, the City Planning Commission set the time and place for a hearing said zone change, and notice of said hearing, together with its purpose was ven by the publication in a newspaper of general circulation in the City at last 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and place as advertised, namely 00 p.m., April 14, 1982, before the Planning Commission and said hearing was 'thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice support the change of zoning for property at 45 North Fourth Avenue from C-C to ISL. 2. The Planning Commission recommends to the City Council that said change zoning be approved. ~,~~~ ~ 3.
