This approval in luded the condition that the owner post a bond in the amount of $2,000. In lieu of posting a bond, the applicant has agreed to the placement of a lien against his property. The owner has si ned the lien agreement and is now ready for Council approval. It is my RE OM MENDATION: That the Council approve subject agreement and au horize the Mayor to execute on behalf of the City. BO~IRD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: Re ently, Mr. Merziotis of Merziotis Properties, Inc. submitted pl ns to enlarge the retail building on his property at 701 Br adway. As the plans were processed through this department, th Traffic Section added the requirement to remove the driveway at the south point of curb return on Broadway. On February 8, 1982, he applied for a deferral of this re uirement. I approved his request with the following co ditions: 1. The term of the deferral is not to exceed 3 years. 2. The applicant is to remove the driveway upon written notice by the City. 3. Applicant is to post a bond in the amount of 52,000 to g uarantee future removal as required by the City. In lieu of posting cash security or a deferral bond in the re uired amount, the owner has agreed to have the City place a ien against his property. Th owner has executed his portion of the lien agreement and has su mitted it for the City's approval.
