TITLE: Resolution /op.s~f Approving right-of-entry
letter to San Diego Gas & Electric Co. and
intention to grant a subsequent easement for
underground electrical service to the proposed
Jimmy's on the Green Restaurant at the Chula Vista
Municipal Golf Course

DI6CUSSION:
Th plans for the building addition to accommodate Jimmy's on the
Gr en Restaurant call for relocation of the electrical power
pa el to the south side of the new addition. According to SDG&E,
th s necessitates the relocation of the existing transformer now
serving the building. This requires the realignment of the
ex'sting underground conduit within an easement granted to SDG&E
in July of 1980. Because this realignment is not defined on the
re .odeling plans, SDG&E desires a right-of-entry letter allowing
them to install its facilities. The City's survey crew
su sequently will plot the new alignment and a defined easement
will be written. A similar right-of-entry letter was granted to
SD &E last February to place its facilities in Greg Rogers Park
to the proposed Boys/Girls club.

The ity of Chula Vista hereby grants to San Diego Gas & Electric Company,
hereinafter referred to as "Permittee", permission to enter upon City-owned
Chul Vista f~1unicipal Golf Course, as shown on attached "Exhibit A", for the
pure se of installation of electrical and gas facilities, subject to the
foll wing terms and conditions:
1. ~fhis permit shall become effective upon execution by City Council
esolution and continue on a month-to-month basis thereafter.
2. his permit is terminable at will by either party, subject to the
rovision that written notice be delivered to the opposite party
hirty (30) days prior to the projected termination date.
3. ity, its successors and assigns, shall retain all right, title,
nd interest in said property, and Permittee covenants not to
ssert any interest in said property in derogation of City's right,
itle, and interest or inconsistent with the permit herein granted.
4. ermittee shall not use the premises in any manner which creates a
uisance or disturbs the peace of the persons residing in the
urrounding area.

nd pay in full any and all loss, damage, or expense that file City
ay sustain, incur, or become liable for resulting in any manner from
he construction, maintenance, use, state of repair, or presence of
ermittee's facilities installed hereunder and all fixtures and
quipment used in connection therewith, including any such loss,
amage, or expense arising out of (a) loss or damage to property,
nd (b) injury to or death of persons, excepting any loss, damage,
r expense and claims for loss, damage, or expense resulting in
ny manner from the negligent act or acts of the City, its contractors,
fficers, agents, or employees.

Permittee shall have the following rights when necessary for the purpose
of installation of its facilities: (a) trim or top, and upon notice to
City, remove any and all trees within the permit area; (b) clear all
brush and other materials within the permit area; (c) cut such roots
within the permit area as may be necessary for tree protection of
Permittee's facilities located therein; provided, however, that
Permittee shall not by its activities hereunder cause any damage to
adjacent property.
The City Engineer will without unnecessary delay process for appropriate
City Council review and action, a request for issuance to San Diego -
Gas & Electric Company of a permanent easement covering the right-of-way
shown on attached "Exhibit A".
Upon termination of this permit, Permittee shall restore said premises to
its original state subject to the satisfaction of the City i1anager and at
no cost to the City.
This action is exempt per City of Chula Vista Environmental Review
Procedure, amended July 8, 1980, implementing the California Environmental
Quality Act of 1970. Refer to Categorical Exemption, 4.3.3., Class 5.
