HomeMy WebLinkAboutAgenda Statement 1982/05/04 Item 10COUNCIL AGENDA STATEMENT Items 10 ~/ Meeting Date 5-04-82 I EM TITLE; Resolution wdJ ~~Authorizing expenditure of funds for preparation of a preliminary assessment spread on properties adjacent to Las Flores Drive S MITTED BY: City Engineer ~ (4/5ths Vote: Yes No x ) City staff, over several years, has been working with property o ners living between Second Avenue and Minot Avenue and north of "E Street in the area shown on the attached sketch for the improvement of Las Flores Drive and "D" Street. Three areas on th attached sketch are identified as outlined in three colors. Th area outlined in red has already filed a petition with the Ci y Council for the formation of an assessment district. The ar a bounded in green includes several property owners which have de errals for public improvements for which they are obligated to in tall. The area in yellow represents an area where some of the pr perty owners have sho wn an interest in an assessment district. Un ortunately, over the past, the property owners in the area as a hole have not been able to form an overall assessment district co eying all the areas bounded in red, green and yellow. One of th major obstacles in obtaining signatures for the formation of a istrict is the lack of the individual property owners having a fairly good estimate of the cost of the improvements for which th y will be required to pay for. It is my RE OM MENDATION: That Council: 1. Authorize the City Engineer to retain the firm of Bement- Dainwood-Sturgeon, consulting engineers, to prepare a preliminary assessment spread on the properties outlined in the attached sketch for an amount not to exceed 53,800. 2. Authorize the expenditure of 53,800 from budgeted project "1911 Act Revolving Fund" - Account No. 600-6000-RC04. B0~1RD/RECOMMENDATION: Not applicable. DISCUSSION: Based upon a public meeting in 1979, Council budgeted funds to in tall 24 foot wide pavement and a storm .drain in Las Flores Drive south of "D" Street and "D" Street between Minot and Second Av nue. The plan decided at that time wastocallupthe deferrals an require the affected property owners to install their improvements, including pavement to center line of street, curb, g u ter, sidewalk, street lights and 1/2 drainag e. A district would help the people with deferrals (in green area) by spreading out their costs over a larger period time and allow lower contractor prices by constructing a -get project now. There also is interest by a few property iers in the yello w area for an assessment district. Pr vious Council actions have appropriated approximately $220,000 fo Las Flores Drive. However, we presented to Council in No ember the necessity to postpone the project in order to have av ilable funding for "H" Street. In February of this year, we met with the property owners within th areas bounded by red and green to discuss the present status of the improvement of Las Flores Drive and "D" Street. It was o u desire to expand the presently approved district bounded in re to include those properties bounded in green. By expanding th district's boundaries to include the area outlined in green wo ld provide a means of financing the public improvements which ar now required to be installed by deferrals. Through the as essment district process the cost of improvements could be pa d off over a period of many years. However, one of the major th m es that cam e across from the property o wners in the ex panded ar a was, "What is it going to cost them for the improvements?". We indicated that we would investigate the possibility of hiring a onsultant to make a preliminary assessment spread of the va ious parcels in the area so that we could better advise the pr petty o wners. We then contacted John F. Dainwood who has had considerable ex erience in spreading assessments. He has made a proposal to us (copy attached) for making a preliminary assessment spread in th areas bounded by red, green and yellow. With the results from his study, we can better inform the pr petty owners as to their expected costs for im provement of the ro d and drainage facilities in the area. It may then be po Bible, with the cooperation of the property o wners to expand th present district shown in red to include possibly both the ar as shown in green and yellow. FINANCIAL STATEMENT: Adequate funds are available for this informal contract. Funds ($50,000) are available in "1911 Act Re olving Fund" - Account no. 600-6000-RC04. The total funds ne ded for the contract are $3,800. Reimbursement of this amount is possible when the district is formed. As discussed, the following lternate methods will be used to indicate assessments: 1. All zones (red-green-yellow) participating. 2. Red and green only participating. 3. Red only participating. feel tht we must consider right-of-way in making the assessment, articularly when certain areas may be reluctant to participate. verlooking right-of-way might cause sizable discrepancies between his preliminary and the actual assessment. I could use an approximate alue per square foot for making the spread. This would give us a airly close estimate of what the assessment would be with dedication y an owner, or purchase. Ultimately, I believe that a formal ppraisal on the property will be necessary to back up the final ssessment. e riunicipal Improvement Act of 1913 with 1911 Act Bonds appears to the best procedure for a district of this size and characteristics. ith the information that you have prepared already, indicating the pproximate boundaries, extent and cost of improvement, we figure that e can prepare a comprehensive assessment of the three alternates list- d above for approximately $3,500. We will do the work on a time-and- aterial basis for the NOT TO EXCEED price of $3,800. preliminary spread such as this reduces the time required and esultant costs of the final assessment.
