HomeMy WebLinkAboutAgenda Statement 1982/04/27 Item 11l~. • COUNCIL AGENDA STATEMENT Item 11 Meeting Date ?~ • • Ordinance / 9~'~' TITLE: -Amending Ordinance 1947, authorizing a twelve (12) month continuation of Section 2.67.025 of the Municipal Code, prohibiting alcoholic beverage consumption in the "J" Street Marina area I SUBMITTED BY: Director of Public Safety (4/5ths Vote: Yes No X In June 1981, the City Council approved an ordinance prohibiting anyone, wi out special permission, from consuming alcoholic beverages in the "J" St et Marina area. The ordinance was effective on July 24, 1981, and had a si month "sunset" clause, which has expired. Wi h the delay in commercial and recreational development in the area, I believe it is advisable to extend the ban until more commercial and re reational traffic is generated in the area. Therefore, it is my RE OMMENDATION: That the prohibition against the consumption of alcoholic be erages be extended twelve (12) months in order to provide continued pr tection against vandalism and public disturbances at the marina. BOARDS/COMMISSION RECOMMENDATION: Not applicable DI USSION: La t year, the problems of vandalism, grafitti and public disturbances in the "J' Street Marina area were reduced by establishing a 10:00 p.m. to 6:00 a.m. cu few and posting a ban on alcoholic beverages. A six-month "sunset" clause wa placed on the alcoholic beverage ordinance. This was considered su ficienresultin wfromelthe emarina h development wouldu cause the problems nto t ffic 9 n turally abate. T date, the curfew and drinking bans have been effective in reducing e forcemeat problems in the area. The marina development, however, has been d layed and, as a result, the Recreation Vehicle park on the north side of the m rina will not be completed until September 1, 1982. The public park areas t the west and south of the RV park will be completed by July 1, 1982. C nstruction of the 600 boat slips, the ship's chandlery, restaurant and other c mmercial enterprises should follow the opening of the RV park. A twelve month extension will provide continued enforcement until the new p blic park areas, including the breakwater pier, and the RV park are open to t e general public and a pattern of use by local residents and tourists is e tablished. It will also provide sufficient opportunity to prevent a "take o er of the area by youth gangs during the initial growth period of the m rina facilities and commercial establishments, via discretionary enforcement. Page 2, Item 11~ Meeting Date /~/2 ~/~~-- • If th s request is approved, it is planned to have the public park areas on the n rth side of the marina posted with signs prohibiting alcoholic beverages prior to its July 1 completion date. Such signs are already posted in the area djacent to the boat launching ramps of the marina. FISCAL.
