The School District has not agreed to dedicate th righ -of-way across their property. Therefore, we will need to begin proceedings to acquire that right-of-way. It is my R COM M NDATION: That Council approve the resolution ap ropri ting $10,000 from the unappropriated balance of the Gas Ta Fund for the East "H" Street project and authorize the City to contact with Alan Comstock for real estate appraisal se vices COMMISSION RECOMMENDATION: Nat applicable. DI6CUSSI0N: Th Eas "H" Street project is currently out to bid. The bid op ening ate will be April 7. We advertised the project as two co tract One for the grading & drainage work and the other for pa ing, uard rails and other surface improvements. Using that pr cedur e, we reserve the option to not award the contract far th e pav ng portion at all, or we have provided for in the co ntrac that we reserve the right for a six month time limit be ~ ore w need to award the contract after opening of bids. This gi es t~ e opportunity of using funds from next fiscal ye ar's bu get f r a portion of "H" Street. Sc ool District Right-of-Wad On March 16, the Elementary School District Board decided to not de icat the necessary right-of-way across their property for Ea t "H" Street. They indicated that they wanted to receive just co pens tion for the necessary right-of-way even though they re lized that it may not be advantageous to them in the long run since a uture developer may be required to pay the City back for th righ -of-way or put in extensive improvements. In order to begin the process, we need to hire an appraiser and up n rec ipt of his report, make an offer to the School District for the fight-of-way. Time is very critical and we do not have time to ego through a formal process of interviewing appraisers since we~ expect to open bids on April 7. He has indicated that he could have an ap raisa report completed to us by April 17. Therefore, if the Co ncil approves this resolution, the City will execute a co tract with him for these purposes. Th cont act will be based upon his regular fees in an amount not to excee $6,500. If our negotiations with the School District ar unsu cessful, we will need to prepare formal condemnation papers nd will need to spend additional monies for the ap raise . FI CAL IMPACT: To date, no funds have been appropriated for East "H Street.
