RESOLUTION OF THE CITY OF CHULA VISTA TEMPORARILY
INCREASING THE SEWERAGE FACILITY PARTICIPATION FEE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS the Federal Environmental Protection Agency has
declared the City of San Diego in violation of the Clean Water
Act, and
WHEREAS it is imperative that San Diego and the
participating agencies take action to upgrade the treatment
system to secondary, and
WHEREAS since Federal funding will not likely be
available or at least not sufficient to upgrade the system, Chula
Vista is partially dependent on growth to pay its way, and
WHEREAS the fee needs to be increased immediately,
otherwise needed revenues to pay our share of the upgrade system
will be lost, AND
WHEREAS the City Council is adopting a resolution which
1 increase the Sewerage Facility Participation Fee within the
~_~y of Chula Vista, and
WHEREAS pursuant to Government Code Section 65962, the
increase in the fee as a result of that resolution will be become
effective until sixty (60) days thereafter, and
WHEREAS developments in the City which will impact
various public facilities will be applying for building permits
during the interim period before the increased Sewerage Facility
Participation Fee becomes effective, and
WHEREAS, Government Code Section 65962 authorizes the
City to adopt an interim fee as an urgency measure upon making a
finding describing the current and immediate threat to the public
health, welfare, and safety, and
WHEREAS, on October 3, 1989, the City Council accepted a
report from the Director of Public Works concerning an increase
in the Sewerage Facility Participation Fee, which provided the
public data indicating the amount of cost and sources of revenue
anticipated for the sewer participation fee in accordance with
Government Code Section 54992.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
~ City of Chula Vista does resolve as follows:

SECTION 1: Finding of Urgency.
That the City Council of the City of Chula Vista finds
that it is necessary that its increased Sewerage
Facility Participation Fee go into effect immediately in
order that all properties especially those in the
eastern section of the City pay their fair share of the
cost of public improvements related to the impacts
caused by their development. Immediate implementation
of this fee is necessary to avoid a possible shortfall
in the amount of money necessary to pay for the various
public facilities or an increased charge to the
remaining property owner. The City Council finds that
the prospect of a shortfall and concerns about the
propriety of an increased charge to remaining property
owners constitute a current immediate threat to the
public health, welfare and safety justifying the
immediate imposition of the fee.
SECTION 2. That Section 13.14.020 Sewerage
Participation Fee of the Master Fee Schedule is hereby
amended to increase the Sewerage Facility Participation
Fee to $2,000 per equivalent dwelling unit of flow.
SECTION 3. This resolution shall become effective upon
its adoption if passed by the affirmative votes of at
least four (4) members of the City Council as a
temporary measure.
SECTION 4. This resolution shall be of no further force
and effect in thirty (30) days. The City Council
directs the City Clerk to bring the resolution back for
two extensions at thirty (30) day intervals so that the
interim fee increase will remain in effect until such
time as the permanent fee increase resolution becomes
effective.
