BACKGROUND: 1. The City Council recently approved a tentative subdivision map, Hilltop Terrace, Chula V sta Tract 82-6, for the development of a 90 unit condominium project at the northea t corner of Telegraph Canyon Road and Nacion Avenue. The boundaries of the tenta- tive ma also included a 0.56 acre C-N zoned property located at the intersection of the two str ets. The tentative map proposed a lot line adjustment between the R-3-P-12 and C-id zoned p operties. The property line is to be shifted to the north side of the covered channel which would result in a new lot being split zoned (R-3-P-12 and C-N) once the final m p is recorded. One of the conditions of approval of the tentative map required that th applicant initiate rezoning action to adjust the zone boundary to coincide with the new lot line which is the subject of this item. 2. The project is exempt from environmental review as a Class 3(c) exemption. B. RE C(DMP9ENDATION: Con ur with Planning Commission recommendation. PLA KING COMMISSI ON RECOMMENDATION: On ~ebruary 10, 1982 the Planning Commission unanimously recommended that Council approve the zone boundary adjustment in accordance with Resolution PCZ-82-D. D. DISCUSSION: 1. Existing site characteristics. Bot the C-N and R-3-P-12 zoned properties in question are currently vacant. However, as indi ated earlier the City has approved a tentative map (Hilltop Terrace) for the develop ent of the R-3-P-12 property. No plans have been submitted for the development of the ommercial property. 2. Lot line adjustment. The proposed lot line adjustment will encompass the covered channel and the proposed down slo es to the north of the channel. The existing C-N zoned lot contains approxi- mately 2 ,390 sq. ft. The new lot will contain an approximate area of 31,880 sq. ft. 3. hand use. The roposed C-N expansion area consists of a covered drainage channel and slopes which ca not be built on, however, the additional area can be used for parking to allow ~ater lexibility in the development of the adjacent commercial lot. PCZ-82-D RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL ADOPTION OF A ZONE BOUNDARY LINE ADJUSTMENT BETWEEN C-N AND R-3-P-12 ZONES FOR PROPERTY AT THE NORTHEAST CORNER OF TELEGRAPH CANYON ROAD AND NACION AVENUE • WHEREAS, a duly verified application for the rezoning of property was filed with the Planning Department by Dale Building Company on January 14, 19 2, application No. PCZ-82-D, and WHEREAS, said application requested an adjustment of the zone boundary line between C-N and R-3-P-12 zones for property at the northeast corner of Telegraph Canyon Road and Nacion Avenue, and WHEREAS, the request is exempt from environmental review as a Class 3(c) exemption, and WHEREAS, the City Planning Commission set the time and place for a hearing • said zone boundary adjustment, and notice of said hearing, together with its purpose was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and place as advertised, namely 7:00 p.m., February 10, 1982, before the Planning Commission and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds at public necessity, convenience, general welfare and good zoning practice support the adjustment of the zone boundary line between C-N and R-3-P-12 zones r property at the northeast corner of Telegraph Canyon Road and Nacion Avenue. 2. The Planning Commission recommends to the City Council the approval of id zone boundary line adjustment as shown on the attached plat. 3. That this resolution be transmitted to the City Council and a copy be sent to the applicant.
