The Final Map is now before Council for approval. is my RE~OM M ENDATION: That Council adopt the resolutions as listed in th title hereto. BO RD/COMMISSION RECOMMENDATION: Not Applicable. DI CUSSION: Th Final Map for Chula Vista Tract 80-29, Vista Knolls Co dominiums, has been checked and found to be in conformance wi h the Tentative Map. The subdivision consists of 74 units on one lot on Second Avenue no th of Orange Avenue (see Exhibit A) being converted from ap rtments to condominiums. The subdivider has obtained a co struction permit and posted a cash bond for the construction of wheelchair ramps and the installation of a street light. The developer has paid all fees and submitted all required documents. All conditions of approval have been met except condition 4 which states: "The developer shall obtain the necessary permits to do the work required for approval by the Design Review Committee within 120 days after the approval of the final map. Such work shall proceed in an expeditious manner and shall be complete 90 days from the issuance of the permits." The developer requested that the condition be amended to read: The developer shall submit a Declaration of Restriction which prohibits the sale of any condominium unit prior to completion of the work required by the Design Review Committee. Said Declaration shall be recorded concurrently with the Final Map. 1 Form A-113 (Rev. 11/79) Page 2, Item X10 Meeting Date ~_~~ 2/23/82 Th developer with the approval of the City Attorney has su mitted a Declaration of Restrictions. The Declaration co tains the statements "that before said apartments are co verted to condominium s, owner shall make certain improvements to the structure pursuant to the recommendations of the Chula Vi to Design Review Committee made on May 1, 1980, as Case No. DR -80-24." and "...that the aforesaid improvements are co structed on the property by Owner or his successor in interest to the property and approved by the City prior to the conveyance of any individual condominium interest in the property." Th City Attorney and I feel that the intent of condition 4 will be met by the recordation of the Declaration. The improvements re uired by the Design Review Committee are listed in Exhibit B an will be completed prior to conversion.
