A the meeting of February 16, 1982, the City Council adopted an
u gency ordinance declaring a moratorium on rents on mobile home
s aces to and until May 11, 1982. As I had indicated in my
e rlier report to the City Council, the ordinance was copied from
t at which had been adopted by the City of Carlsbad and had been
h ld to be valid by the court, so it was adopted with no changes.
H wever, requests have now been received both from the park owners
a d the mobile home owners to make certain modifications which
s em fair and reasonable.
R~~COMMENDATION: Adopt urgency ordinance amending Ordinance No. 1972
DISCUSSION:
T e ordinance provides in Section 3, subsection (3) for an
e ception to the prohibition on the adjustment of rents. However,
t at section is merely limited to the voluntary vacancy of a
m bile home space during the period of the moratorium allowing for
a increase at the time said space is re rented.
I is apparent that two additional exceptions should be included.
T e first would be the situation where the park owner has obtained
t e approval of a majority of the mobile home space renters for a
p oposed rental increase. The second exception should cove r the
situation where a notice of a proposed increase has been issued
p for to the effective date of the urgency ordinance. This latter
e ception in all probability already exists under the inter-
p etation of the state law.
I addition to these two exceptions which have been added to the
m ratorium on mobile home space rental increases, the ordinance
h s been modified to eliminate the term "rental unit" and "tenant"
a d to designate and define such as "mobile home space" and
" obile home owners". This seems to be an area of some sensi-
t'vity to the owners and does not in any way modify the terms and
c nditions of the ordinance.
URGENCY ORDINANCE /
~~ys- Amending Ordinance 1972 Declaring a Moratorium on Rental
Increases on Mobile Home Spaces within the City of Chula Vista from February 16,
1982 to and until May 11, 1982 -First Reading and Adoption
have amended Section 2 to indicate that the presently
ignated Ad Hoc Committee will continue to function as the
mittee to address the problem of mobile home space rentals.
