HomeMy WebLinkAboutAgenda Statement 1982/02/23 Item 8aw COUNCIL AGENDA STATEMENT Item ~n ~ ' Meeting Date 2-23-82 ITEM TITLE: Resolution ~~ 7 ~ - Approving an Agreement Between the City of Chula Vista, City of National City and the Lower Sweetwater Fire Protection District SUBMITTED ~Y: City Manager ~~'~ ~~ (4/5ths Vote: Yes No X ) The cities of Chula Vista and National City received a letter from the Lower Sweetwater Fire Prote tion District in January 1981 indicating the District's interest in discussing a contract to provide fire protection services to their area. The City Councils of Chula Vista and ational City were both receptive to entering into discussions and those discussions have been eld for the better part of last year. Agreement has now been reached on contract provisions and said agreement has been executed by the Board of Directors of the Lower Sweetwater Fire Protection District. The agreement is acceptable to the City P1anager of National C'ty and will be presented to his City Council on February 23, 1982. The agreement 's acceptable to me and therefore, it is my RECOMMENDA~'ION: That the City Council adopt this resolution. BOARD/COMMISSION RECOMMENDATION: N.A. DISCUSSION The main p rpose of the agreement is to provide fire protection and emergency medical service to the district area pending final resolution of the dissolution question and possible a nexation of that area in an acceptable manner to the two cities. The agreement does not a sure or dictate that annexation will occur but the underlying intent of the agreement ssumes that a continuing effort will be made to dissolve the district and work out s me acceptable annexation strategy for the area. That date was anticipated to be approximately March 1, but due to of the approval of the agreement, the effective date of the agreement probably before April 1, 1982. 4Jhile the agreement intended to remain in full force until January 1, 1984, the termination provision provides that it may be by any of the three parties hereto upon delivery of a written notice of intent e, with termination effective three months from the receipt of the notice or er date as may be mutually agreed upon by the parties. ant also provides under Section 6 thereof that the payment for said fire protection 11 be made on a quarterly basis with a "first year period involving the total 20,000". The $120,000 cost will be adjusted on an annual basis with the District the actual cost each quarter. Under the terms of the agreement, future year be negotiated upon the request of either party prior to commencement of that iod. The District further agrees to pa,y off the Public Employees Retirement or service costs of approximately $64,000 owed to that system on behalf of full-time paid employees of the District. Page Two, Ttem 8A Meeting Date 2-23-82 It is th intent of the agreement that the three full-time fire suppression personnel of the Dist ict upon the effective date of the document will be treated as employees of the resp ctive fire departments of the cities and shall receive the same benefits and salaries as shown in Exhibit B of the Agreement. If the agreement should be terminated, the citi s may, but are not required, to retain said District personnel. If of course the Dist ict is dissolved and the area is annexed to the respective cities, the District personnel will be integrated into the departments at the existing City salaries and ranks as the employees of the City during that period that contractual protection is furni she . Chula Vi to and National City will be responsible for determining the appropriate division of the t tal annual sum for the service provided by each City. It is currently the intent of the p rties that two of the three full-time members of the Districts personnel will become e ployees of the City of National City and the third member an employee of the City of hula Vista. Public Safety Director l~linters has indicated that while fire pro ection services could as a practical matter be furnished to that area that will be this City's responsibility under the terms of this agreement, the additional man can e effectively and productively used by the Chula Vista department. FIPJANCIAu IMPACT Under th terms of the agreement, the City of Chula Vista will be reimbursed in full for costs associated with the service provided. Chula Vista's fair share of the first years' $120,000 will represent full cost of the one fireman contemplated to become a Chula Vista employee and all associated fringe costs.
