to San Diego Gas & Electric Company and intention
to grant a subsequent easement for underground
electric service to proposed Boys/Girls Club in
Greg Rogers Park

In order to serve the proposed Chula Vista Boys/Girls Club
bu' ld ing in Greg Rogers Park, SDG&E i s requiring the club's
co tractor to trench and install conduit for its underground
el ctric facilities. Because SDG&E does not know the exact
to ation of the proposed trench, it desires to install its
fa ilities under the terms of a right-of-entry letter (Exhibit B,
at ached). Subsequent to the installation, the facilities must
be surveyed and a legal description written for a defined
ea ement .
RE OM M ENDATION: That the Council approve subject right-of-entry
le ter and authorize the City Engineer to sign the letter.
BO~RD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
In conj unction with the proposed construction of the Chula Vista
Bo s/Girls Club in Greg Rogers Park, San Diego Gas & Electric Co.
mu t provide underground electric service to the building. SDG&E
re uires that the developer provide the trench for its conduit
an wires .
Th service will begin on the west side of Oleander Avenue just
so th of Oak Place and enter Greg Rogers Park directly across
Oleander. From that point, it will extend approximately 160 feet
no theasterly to a pad mounted transformer near the proposed
bui ding as shown on Exhibit "A" .
To expedite the installation of these facilities, SDG&E has
req ested the City to grant a right-of-entry letter. The normal
pro edure is to grant a certain easement in which the com pany may
loc to facilities. Ho wever, the Boys/Girls Club is responsible
for the trenching and SDG&E has no knowledge of the final
loc tion at this time.

It is my intention to have the City survey crew locate the
fa ilities at the time of installation. From these survey notes,
a egal description may be written and a defined easement may be
granted permanently. As stated in Item No. 7 in the attached
letter, I will have a permanent grant of easement prepared
im ediately following receipt of the survey information.
I recommend that the City Council approve the right-of-entry to
SD &E and authorize the City Engineer to sign the letter.
I lso recommend that City Council give its intention of granting
an easement after the facilities are installed.

Th City of Chula Vista hereby grants to San Diego Gas & Electric Company,
he einafter referred to as "Permittee", permission to enter upon City-owned

1. This permit shall become effective upon execution by City Council
resolution and continue on a month-to-month basis thereafter.
2. This permit is terminable at will by either party, subject to the
provision that written notice be delivered to the opposite party
thirty (30) days prior to the projected termination date.
3. City, its successors and assigns, shall retain all right, title,
and interest in said property, and Permittee covenants not to assert
any interest in said property in derogation of City's right, title,
and interest or inconsistent with the permit herein granted.
4. Permittee shall not use the premises in any manner which creates a
areaance or disturbs the peace of the persons residing in the surrounding

and pay in full any and all loss, damage, or expense that City may sustain,
incur, or become liable for resulting in any manner from the construction,
maintenance, use, state of repair, or presence of Permittee's facilities
installed hereunder and all fixtures and equipment used in connection
therewith, including any such loss, damage, or expense arising out of
(a) loss or damage to property, and (b) injury to or death of persons,
excepting any loss, damage, or expense and claims for loss, damage, or
expense resulting in any manner from the negligent act or acts of the
City, its contractors, officers, agents, or employees.

Permittee shall have the follow~iny rights when necessary for the purpose
of installation of its facilities: (a) trip or top, and upon notice to
City, remove any and all trees within the permit area; (b) clear all
brush and other materials within the permit area; (c) cut such roots
within the permit area as may be necessary for the protection of
Permittee's facilities located therein; provided, however, that Permittee
shall not by its activities hereunder cause any damage to adjacent property.
The City Engineer will without unnecessary delay process for appropriate
City Council review and action, a request for issuance to San Diego Gas &
Electric Comapny of a permanent easement covering the right-of-way shown
on attached "Exhibit A".
Upon termination of this permit, Permittee shall restore said premises to
its original state subject to the satisfaction of the City Manager and
at no cost to the City.
This action is exempt per City of Chula Vista Environmental Review
Procedure, amended July 8, 1980, implementing the California Environmental
Quality Act of 1970. Refer to Categorical Exemption, x.3.3, Class 5.
