The improvement agreement was ap roved by Council Resolution 8320, dated September 14, 1976. It is my RECOMMENDATION: That Council adopt resolution. BO1~RD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: On Aug ust 21, 1979, a final inspection of the public improvements wa conducted and a letter of corrective work, dated August 29, 19 9, was sent to V and V Development. On November 3, 1980, V nd V Development finally completed all the items to the sa isfaction of the City Engineer except one. Th one item not performed was the posting of surety to guarantee th improvements for a period of one year after acceptance by the Ci y Council. City Code Section 18.16.330 requires that the de eloper place with the City a cash deposit or bond in the am unt of 15$ of the surety posted for improvements, which in th's instance is $45,900.00 Be ause these improvements were essentially completed in 1979, ex ept for corrective work, and because all the corrective work ph sically needing to be performed to the public im provements was do e in 1979 with only "paper work" submittals remaining, the Ci y Attorney feels that the purpose of the maintenance bond has be n fulfilled. On December 29, 1981, an inspection of the public improvements wa made by Engineering and no problems were discovered. A check wi h John Crouse, Director of Public Works Operations, shows that no complaints or problems have been received by him. We are recommending that the public improvements be accepted by th City Council. FI~CAL IMPACT: im rovements .
