These three designations collectively c mprised the Chula Vista Solid Waste Enforcement Agency. ~ I 1977, the SSWMB in order to expedite the establishment of the ~ L cal Waste Enforcement Agencies did not insist that Enforcement Program plans accompany the submission of the agencies e forcement agency designations required by AB 2439. We are now, h wever, required to submit such Enforcement Program Plans. It i my R C OM M ENDATION: That Council adopt the resolution approving the ~, C ula Vista Solid Waste Enforcement Program Plan. D SCUSSION: T e goal of the Local Solid Waste Enforcement Program Plan is to a sure that all residential, commericial and industrial solid astes are stored, transported, transferred/processed and disposed of in a safe, sanitary, and environmental acceptable manner. To aid the local agencies in the preparation of their ~' Enforcement Program Plan, the SSWMB prepared guidelines c ntaining the various components required by law. The Chula Vista Solid Waste Enforcement Program Plan is based on the guidelines and has been reviewed by County of San Diego's Solid aste Program Manager. Our plan will become a part of the E forcement Element of the San Diego Regional Solid Waste Management Plan (CoSWMP) . .r Page 2, Item 8 ' Meeting Date 1-26-82 A 2439 requires that the major enforcement functions be p rformed by either the State or County Health Departments. U der the law, the State Department of Health is to regulate all C ass I solid waste facilities. There is only one such facility 1 Gated within the City limits. It will be located off Maxwell R ad next to the Otay landfill. This facility is a transfer s ation and is not yet operational. The San Diego County Health ' D partment regulates the Otay landfill (Class II waste disposal s'te) in accordance with a permit issued by the State of C lifornia. A cording to the regulations, the City staff's responsibility is i vestigation of citizen complaints pertaining to collection of w ste by the Chula Vista Sanitary Service, zoning violation m tters and land use regulation only. Since these functions are n w being conducted by the City (see attached Table of ` O ganization), this plan is expected to have minimal impact upon t e City's resources.
