HomeMy WebLinkAboutReso 1989-15310 (a) RESOLUTION NO. 15310 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REVISING CONDITION OF APPROVAL 15(a) OF RESOLUTION 13173 (OTAY RIO BUSINESS PARK) The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Condition of approval 15(a) for Tentative Subdivision Map of Cnula Vista Tract 87-6 currently requires that: "The developer shall enter into a development agreement restricting the issuance of building permits when the traffic volume on Otay Valley Road, immediately east of Nirvana Avenue, reaches 7100 ADTS as determined by the City Engineer. The development agreement shall provide developer with the option, but not the obligation, of widening Otay Valley Road, crossing over the Otay River and westerly to Nirvana Avenue. Upon securing and commencing construction of the improvements widening Otay Valley Road, developer may obtain further building permits. A permit may De required by the Army Corps of Engineers for said work." WHEREAS, when the Precise Plan for the development came ~ore Council, staff was directed to change the condition to ~_~clude the road improvement all the way to 1-805 and to delete the 7,100 ADT and include the new threshold standards, and WHEREAS, the proposed condition of approval 15(a) to be modified reads as follows: "The developer shall enter into an agreement whereby the developer agrees that the City may withhold building permits for any unit in the subject subdivision if traffic in Otay Valley Road between freeway 1-805 and the subject project has a level of service poorer than C at any intersection with the exception that level of service D may occur at signalized intersections for a period not to exceed two hours per day in accordance with the adopted City's Thresholds." "The agreement shall provide developer with the option, but not the obligation, of widening Otay Valley Road, crossing over the Otay River and westerly to Nirvana Avenue.
