Portions of the under- grou ding District lie within boundaries of the City of Chula Vista. The aunty Board of Supervisors adopted a Resolution of Intention for this undergrounding project on March 20, 1979. A public hearing on this matt r was held on April 18, 1979 by the Board of Supervisors. The Board at t at meeting passed an ordinance approving the formation of the District. A co y of the ordinance and minutes is attached. In order that the por- tion lying within the City can be included in the undergrounding district, the aunty has requested that the City of Chula Vista establish an under- grou d utility district to include these portions. There are 17 City parcels within the boundaries of the proposed underground district. Ther will be n~o cost to the City for the undergrounding of the utilities. The ntire undergrounding cost will be paid by the County from funds allo ated to the County by San Diego Gas and Electric Company. Sect'on 15.32.130 of the Chula Vista Municipal Code requires that City Coun it set a public hearing to ascertain whether the public health, safe y, and general welfare requires the undergrounding of existing over- head utilities within designated areas of the City and to give persons the oppo tunity to speak in favor of or against the formation of a proposed dist ict to underground utilities. Sect'on 15.32.140 requires that the City Clerk notify all affected persons and ach utility company of the time and place of the public hearing at leas 15 days prior to the date of the public hearing. The City Clerk is required by t is section of the Code to publish the Resolution of Intention setting a pu lic hearing in the local newspaper no less than five days prior to the date of the public hearing. If a~District is formed, individual property owners will have to convert thei service from overhead to underground. This will be at their expense. Goldkamp, Senior Civil Enginee Subject: Public Hearing for the Formation of Underground Utility District Along Third Avenue from Hermosa Avenue to "L" Street The City Council, at its meeting of May 1, 1979, will adopt a resolution setting May 22, 1979 as the date to hold a public hearing on the formation of an underground utility district along Third Avenue. Chapter 15.32.140 of the Municipal Code requires that the City Clerk: 1. Notify all affected persons and each utility company con- cerned of the time and place of the hearing at least 15 days prior to the date thereof. Attached is a list of the property owners and their addresses of those City parcels to be included within the boundaries of the proposed underground district. 2. Notices must be mailed both to the property owner and to the occupant of the property. Notices to occupant may be addressed to "Occupant". 3.
